extreme northwastedy end of the arc of a curve which connects the northwestern side of Sage Spur and the
southwesterly side of Kerwin Boulevard and from said point of beginning;
BEGINNING at a point on the southwesterly side of Kerwin Boulevard 297.00 feet northwesterly from the
extreme northwesterly end of the arc of a cuwe which connects the northwesterly side of Sage Spur and the
southwesterly side of Kerwin Boulevard and from said point of beginning;
RUNNING THENCE along the division line between lots 3 and 4 on the above mentioned map south 46 degrees
50 minutes 20 seconds West 250.00 feet;
RUNNING THENCE north 45 degrees 09 minutes 40 seconds West 159.44 feet to lot 2;
RUNNING THENCE along the division line between lots 3 and 4 on the above mentioned map south 46 degrees
50 minutes 20 seconds East 257.98 feet to the southwesterly side of Kent~in Boulevard;
RUNNING THENCE along the southwesterly side of Kerwin Boulevard the following 2 courses and distance;
1) south 34 degrees 59 minutes 00 seconds East 56.12 feet;
2) south 43 degrees 09 minutes 40 seconds East 103.88 feet to the point or place of BEGINNING
BEING AND INTENDED TO BE the same premises as described in deed mede by Zoumas Contracting
Corporation recorded November 28, 2001 in Liber 12155 page 392.
TOGETHER with all right, "tie and interest of the party of the first part in and te any streets and roads abutting the
above described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to said premises. TO HAVE AND TO HOLD the premises herein granted
unto the party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part convents that the pa~cy of the f',~t part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using nay part of the total of the same for any other purpose.
The word 'party" shall be construed as if it read "parties' whenever the sense of this indenture so requires.
