CURCIO, residing at I 526 East 20" Street, Apt. IE New York, NY 10009 party of the first part, and GERARD J. CRILLY, residing at 60 47 75" Street Elmhurst, NY 11373 party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot,piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Mattituck in the Town of Southold, County of Suffolk and State of New York, and part of a tract of land conveyed to the former owners, Leone D. Howell and Lena F. Howell, his wife, by Mabel Hollister Houghton by deed dated the 17' day of November, 1925, recorded in the Office of the Clerk of the County of Suffolk in Liber 1164 cp 180 on the 11"day of January, 1926. Said lot is on the north side of a right of way 30 feet wide established and now laid out by the former owners running westerly from another right of way twenty-five(25) feet wide established by an agreement between Reeve, Tilly and Hollister, and recorded in the Office of the Clerk of the County of Suffolk in Liber 629 page 168 on September 5, 1907, bounded and described as follows: BEGINNING at a stone set in the northerly side of said East and West right of way 733.29 feet westerly from the intersection of said north side of said east and west right of way and the westerly line of said north and south right of way established by the said agreements between Reeve, Tilly and Hollister; RUNNING THENCE along said thirty foot right of way the following two (2) courses: 1) South 76 degrees 38 minutes 50 seconds West 58.05 feet to a concrete monument; 2) South 64 degrees 07 minutes 50 seconds West 55.91 feet; THENCE along other land of the former owners, the following three (3) courses: 1) North 8 degrees 32 minutes 20 seconds East 192.12 feet; 2) Along a tie litre parallel to and 30 feet southerly from the northerly line of the former owners North 84 degrees 50 minutes 50 seconds East 103.51 feet; 3) South 8 degrees 44 minutes 40 seconds West 163.38 feet to the point or place of BEGINNING. TOGETHER with the right to pass and repass over the right of way established by an agreement between Reeve, Tilly and Hollister from New Suffolk Avenue as far south as the hereinabove described east and west right of way(but no further south) thence over the said east and west right of way as herein described to the westerly line of the lot herein conveyed and a right to the water facilities therein. TOGETHER with a right of way to the shore of Peconic Bay over a strip of land lying to the west of premises conveyed Dist. by the former owners, Leone D. Howell and Lena F. Howell, his wife, to Fred M. Jones, being 60.5 feet on the southerly 1000 side of the last mentioned right of way and 95 feet in width on the bulkhead line on the shore of said Peconic Bay, this strip Sec. of land being set aside by the former owners for the use of purchasers of lots having no other access to the waters of 122.00 Peconic Bay and shall be used in common with by such purchasers and such right of way shall be construed as running with Block the land herein conveyed and may not be conveyed separately by the purchaser herein. 09.00 Lot BEING AND INTENDED TO BE the same premises described in the deed of the parties of the first part herein by 008.000 deed from Eugene D. Bozzo and Georgene M. Bozzo, dated June 12, 1986, recorded in the Suffolk County Clerk's Office on June 19, 1986, in Liber10062, Page 329. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND the party of the first part, in.compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
