INSEL, c/o Kelley Drye & Warren LLP, 101 Park Avenue, New York, NY 10178 as Trustees under Agreement dated August 20, 1997. party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land. with the buildings and improvements thereon erected, situate, lying and being W¢t at Mattituck, Town of Southold, County of Suffolk, State of New York, being more particularly bounded and described as follows: BEGINNING at a point on the ordinary high water mark of Deep Hole Creek, 55 feet, more or less, easterly along said high water mark from the northeasterly corner of land of Carey; running thence easterly along said high water mark, 75 feet, more or less; thence along other land ofthe party of the first part, South 20° 40' East 150 feet, more or less, and through two iron pipes to ordinary high water mark of Peconic Bay; thence westerly along said high water mark, 80 feet, more or less; thence along other land of said party of the first part, North 17G 10' West 175 feet, more or less, and through two iron pipes to the point of beginning. TOGETHER with a right of way over the existing travelled road to Bungalow Road and subject to a right of way of others over said existing travelled road as it crosses the premises conveyed hereunder as per an Agreement dated the 18th day of November, 1976, and recorded in the Office of the Clerk of the County of Suffolk on May 13, 1977, in Liber 8235 of conveyances at page 397. TOGETHER with the right to lay and maintain a pipe in the bed of the traveled roadway for the purpose of supplying domestic water from Bungalow Lane to the subject premises. TOGETHER with an easement to lay and maintain a pipe for the purpose of supplying domestic water over the following premises: Commencing at a point in the northeasterly line of Bungalow Road where the same is intersected by the southeasterly line of land now or formerly of Kopf; running thence North 26° 49' East along said land now or formerly of Kopf a distance of 5 feet to a point; thence South 57' 43' East along a line parallel to the northeasterly line of Bungalow Road and distant 5 feet therefrom throughout a distance of 135 feet, more or less, to the hereinabove mentioned traveled (SEE RIDER ANNP.XED HERETO) TOGETHER with all right, title and interest, if any. of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part. the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
