party of the first part,
MATTHEW E. RICE, residing at 32 West 72"d Street, New York, New York; and
DANIEL RICE, residing at 31 Town Path, Glen Cove, New York, 11542; and
THOMAS RICE, residing at 26 South Bayles, Port Washington, New York, 11050; and
JAMES A. RICE, residing at 404 Howard Road, Cherry Hill, New Jersey, 08032; and
PATRICK F. RICE, JR., residing at 16 Native Dancer Lane, Saratoga Springs, New York, 12866;
and
MARY RICE LOTT, residing at 106 Oxford Avenue, Clarendon Hills, Illinois; and
KATHLEEN RICE REGAN, residing at 425 Woodbine Avenue, Syracuse, New York, 13206,
ALL AS TENANTS IN COMMON
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTEN ($10.00) dollars,
lawful money of the United States paid by the party of the second part, does hereby grant and release unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain ploh piece or parcel of land, situate, lying and being at Arshamomaque (Greenport), in
the Town of Southold, County of Suffolk and State of New York, known and designated as and by Lot No.
28 as shown on a certain map entitled, "Map of August Acres, Section 1" and filed in the Office of the
Clerk of the County of Suffolk on June 3, 1991, as Map No. 9107, bounded and described as follows:
BEGINNING at a point on the northwesterly side of Pheasant Place at the extreme southerly end of an arc
ora curve which connects the southwesterly side of August Lane with the westerly side of Pheasant Place;
RUNNiNG THENCE along the northwesterly side of Pheasant Place, South 46 degrees 50 minutes 20
seconds West, 220.00 feet;
THENCE North 43 degrees 09 minutes 40 seconds West, 164.00 feet;
THENCE North 46 degrees 50 minutes 20 seconds East, 245.00 feet to the southwesterly side of August
Lane;
THENCE along the southwesterly side of August Lane, South 43 degrees 09 minutes 40 seconds East,
139.00 feet to the extreme westerly end of the arc of the curve first above mentioned;
THENCE along said curve bearing to the right having a radius of 25.00 feet a distance of 39.27 feet to the
northwesterly side of Pheasant Place at the point or place of BEGINNING.
BEING AND INTENDED'TO BE the same premises conveyed to the parties of the first part by deed dated
January 14, 2000 recorded in the Office of the Clerk of the County of Suffolk on January 18, 2000 in Liber
12014 Page 0421.
THE GRANTORS HEREIN RESERVE ~he right to the exclusive use and occupancy of the premises
during the Grantors' lifetime, with the Grantors to pay for all maintenance and repairs, water and
sewer charges, insurance charges, and taxes relating to said premises. Said life use shall be personal
to the Grantors, and shall not be subject to assignment or lease.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
)remises.
fO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section '13 6fthe Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a t~ust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
