We acknowledge receipt of your letter of August 20th with
enclosure of the papers dealing with the formation of the East-West
Fire Protection District adjoining the Village of Greenpor%
These papers give us a complete picture of the district
formation as required by our standards and on receipt of the maps
of the fire district we will be in a position to take any action
warranted in recognition of this district for fire insurauoe purposes
Of course, the ultimate degree of recognition will have to await
the installation of hydrant protection, which may be some months
in the future.

Gentlemen:
Attached is e list of fire hydrants installed in the East-
West Greenport Fire Protection District, Town of Southold, on existing
water mains.
These hydrants were aDproved by the Suburban Division New
York Fire Insurance Bating Organization es of Aug. 8, 1947. It is my
understanding as per agreement that these hydrants became a charge
to the Town as of Aug. l, 1947, which will be a charge of 5 months
per hydrant for the year 1947. There are s total of 52 hydrants. The
total charge for the year 1947 would be ~66.65.

Gentlemen:
It has come to our attention that there has been some mieinter-
pretatlon of our letter to ~rou ds.ted April 2, 19~6, regarding the
charge for hydrants in the proposed fire protection district.
That letter was in reply to ~rour communication Oated November 16,
19~5, wherein you requested rates for "hydrant service for so much of
this territory au is now piped for Village water."
So f~r ss that part of the district where our mains are not
installed is concerned, we will extend our mains and furnish water
for fire protection purposes upon condition that the district agree
to accept ten hydrants per mile at the r~.te of ~0. per ~¥drant per
year for a term of five years.

We v~sh to acknowlemge receipt of your letter of August
24th relating to an opinion of this Department contained in
i Op. Compt. 49~ (File 919).
The above mentioned opinion v~s ~itten on October 26,
1945. By Shapter 859 of the Laws of 1946, section 184-a of
the Town Law was added ~ich pe~its contracts to be entered
into in behalf of fire protection districts for a supply of
water and a rental of hydrants. Such section provides that the
contract shall be entered into with either a water company
or a water vmrks corporation maintaining a water supply system
in the fire protection district. It does not authorize the
entering into a contract with a village.
Section 234 of the Village Law relates to the sale of
water by a village for fire protection purposes outside the
village. It is not broad enough however to apply to fire
protection districts. It is possible that the provisions of
this section could be extended to apply to fire protection
districts and fire a~arm districts at the ~xt session of
the Legislature. Will you kindly examine this section and
advise whether it ~uld be practical in your situation. Under
the oresent provisions of the statute, we do not find a~y
authorization for a fire protection district to enter into a
contract for a supply of water and for hydrant service with &
village.

Dear Sir:
I represent a number of taxpayers of the East-
West Greenport Fire Protection District.
The District's present contract for protection
with the Village of Greenport is in its last year and
it is not too soon, I believe, to consider what is to
happen when that agreement expires.
It is respectfully requested that an early date
be fixed for a public hearing on this matter.
There will be, with Justification that will be
made apparent to the Board at the hearing, much opposition
to a renewal of the present fire and water contracts on
the same financial terms.
It might be observed that for the year 1949-1950
the Orient district,with its own fire station and apparatus
and with an assessed valuation almost identical with the
East-West district~,paid at a rate of but .189 as against
· 3664 for the East-West district.
In fact, the Protection District paid a higher
rate than any one of the 7 districts in the Town with the exception
of Southold.
Since extended negotiations may be necessary before
a new contract, if there is to be one at all, is executed,
it is urged that preparation be commenced at once.

This statement is submitted in lieu of a personal appearance;
the urgent necessity of attending another public hearing precludes
the w~iter's appearance.
I represent and am authorized to speak for a group of tax-
payers in the East/West District who are not as yet formally
organized. These individuals, however, are the owners of property
valued at upwards o£ $250,000. Moreover, I am personally the legal
owner of land situated in the district and speak on my own behalf
as well as on the part of those whom I represent. We will advance
for your serious consideration several propositions.
At the outset, let me say that we are keenly aware of the
necessity for fire protection in the district. We have no thought
that the district shoald be dissolved, nor do we believe a change
to a fire district is indicated~ but as residents and tax-payers
of the only fire protection district in the to~za, we believe that
under the present contracts too much money is being paid the Village
of Greenport.
The writer is familiar, having been associated with the Village
government at the time, with the events leading up to the formation
of the district, and the preparation of fire and water contracts
subsequently entered into.
You will recall that when price was under consideration a somewhat
arbitrary figare was finally arrived at based on what was then little
more then "best guess"~ as to the value of the services proposed to
be rendered.
Five years of experience have indicated that the value of the
services was fixed et too high a rate.
Unfortunately~ we have no accurate records of the n~ber of
fires in the district's area prior to the formation of the district
ana it can hardly be said that a period of five years is ample to
furnish an accurate sample for fixing the value of the services
of the Greenport Fire Department for any lengthy time in the future~
but on the basis of our experience under the present contract it
appears that without any unfairness to the Village the cost of the
services to be rendered over the period of the next five years
could easily be halved.
There are several reasons why this is so. Firstly, comparing
· the budgets of t~ district and t~ village respectively with the
fire losses we find that the district paid substantially more than
the fire losses sustained, while the village budget hardly
approximated the fire losses. Over the period of the last five
years the district was taxed over $20~000 for its fire protection
taxes and there were within the district but two substantial
fires destructive of insurable property, namely, one at Sill's
farm and one to the barn in back of Mr. Herbert Fordham's dwelling.
Disregarding the contribution of the district, f~e protection
for the village has cost the tax-payers roughly $30~000, and the fire
losses within the village have exceeded that amount. In co~ection
with this last figure it should be noted that the estimates of losses
reported by the Greenport Fire Department are far too low. It has
been the personal experience of the writer, as a fire insurance
agent, that at times adjustments have been made in amounts exceeding
by five times the amount of the individual losses as estimated by
the Fire Department.
As respects cost against annual damage, then, the district.
is p~ying well over fifty percent too much under its present contracts.
Secondly, the tax rates for the district is disproportionately
high as respects the costs to all the other districts in the town.
By way of comparison there is set forth for the last three fiscal

Taking the last year as an example~ it will be seen that the
budget for the east/west district which has absolutely no property
or equipment of its own~ paid at a rate substantially higher than
every othe? district in the to¥~n witL the ~xception of the Sout~old
F~e District. On the bas~s of the assessed valuation, the east/

Third!y~ it is a matter of common lanowle¢]ge that the Greenport
~ire Department regards the contract wit~ t~. distr~ct as one which
will enable it to co~tL,~ue to replace ~.I1 of its app~?atus as
rapidly as it is depr~ci~ted. The replacen,ent of apparatus figure
in the vi!]age's fire department budget is the largest ite~:~ therein
and it becmne~ s evident that the district is expecteS to contribute a
dispr%~oi.t~onate!y large part of th village's budgot for fire
protection. As r~g~,rds the respective assesse~_] validations in ti~e
district ~nd th~ v~llage: the contribution of the village should
be twice that cf the distr~ct. Certainly th~ vi!lage~ with an
assessed valuation of over thr~ million should not expect the
contribution of the district~with an assessed valuation of but little
more than one-~alf that mmount~ to p~,y for the continuing replacem~'~t
of all of the vill~ge's apparatus~ whic~
sccounte~ for over fifty- percent of
budgets.

clear tkat it is the .duty of the Gre(nport Fire
Department to take prompt and effective ma&sures to zone the
district for a more adequate alarm system. Some consideration
should be given at least so far as the formation of a joint
com~iittee is concerned looking toward the possibility of the
extension of the electrical alarm system of the village throughout
the district.
Another proposal is that the Town Board carefully re-ex,line
the water contract and make an endeavor to reduce the hydrant
rental to a figure more in conformity with actual value. The
Supervisor and perkaps otl]er members o£ the Board will recall
that there is a moven~nt throughout not only the county but the
state to reduce hydrant rentals to reasonable figures.
This Board should approach this problem realistically. It
should recognize that ~,hile the Village must have the consent
and cooperation of its volunteer £~re department~ the me~e~s
of the latter see~ in continuing the contracts with the district~
a method of replacing and renewing their apparatus which heretofore
was little more than wishful thinking. The Board~ for the benefit
of its tax payins constituents should drive a hard bargain. The
figure finally arrived at shoald be one which is fair,not
confiscatory. Such a figure should not in any case exceed $3000.
Referring back to the tables~ it becomes im~ediately apparent
that it would be better for th~ district to change its status
from a fire protection district and become a fire district'with
its own department than to continue to pay as it is under the present
contracts.
In conclusion, the group I represent would like me to present
something in the nature of a complaint. This has to do with the
adjustment of assess~ents as the result of the formation of the
£ire protection district. Since the formation of the district
no such adjustments have been made.. Persons ownir-g residences
and buildings in t¼e district have had advantages accrue to them
that have not accrued to the owners of f~r~s and vacant lands.
Moreover, those who live within the area where the water ~ains
of the village extend have had even much greater advantages
accrue to them than to those without that area.
Propel' adjustments in the assessments should be made to
compensate for those various advantages and disadvantages to the
individual persons involved.
S~ming up, th~n~ we feel that this Bo~,rd sho~ld not arbitrarily
enter into a simple renewal contract. The experiences of the last
five years should be taken ~nto consideration: as should the
tax rate~ respective assessed valuations~ budgets~ fire losses:
and the lite. In the !i~ht of inevitable findings, we submit,
it will be obvious to the Doard that a contract much more
to the people of the district could and should be entered
