TItIS EASEMENT AGREEMENT, made this -~r~ay of
February, 2002, between Paul J. Corazzini, III, hereinafter referred to as
Corazzini,-residing at 3120 Albertson Lane, Greenport, New York and
James Melrose, residing at 600 Robinson Lane, Greenport, New York,
hereinafter referred to as Melrose.
WITNESSETH:
WHEREAS, Corazzini is the owner in fee simple of a parcel of land,
with the buildings thereon erected, known as Lot No. 2 of a minor
subdivision "Map of the property of William Wickham, and further
described as Suffolk County Tax Map Number 1000-052.00-05.00-058.002,
in the Town of Southold, County of Suffolk, State of New York; and
WHEREAS, Melrose is the owner in fee simple of a parcel of land,
with the buildings thereon erected, known as Lot No. 1 of a minor
subdivision "Map of the property of William Wickham, and further
described as Suffolk County Tax Map Number 1000-052.00-05.00-058.001,
in the Town of Southold, County of Suffolk, State of New York; and
NOW, THEREFORE, in consideration of the premises and of the
sum often ($10.00) dollars each to the other paid the receipt of which is
hereby acknowledged and other good and valuable consideration, Corazzini
grants and conveys unto Melrose his heirs, executors, administrators,
successors and assigns, which come into title to said Lot 1 covenant and
agree as follows:
ONE: An easement shall be created along Albertson's Lane,
Greenport, New York on a parcel of land known as Lot No. 2 of a minor
subdivision "Map of the property of William Wickham, and further
described as Suffolk County Tax Map Number 1000-052.00-05.00-058.002,
in the Town of Southold, County of Suffolk, State of New York for the
purpose of establishing a water service line which will provide water to said
Lot No. 1, including but not limited to, the privilege and right to install,
repair and maintain the water service line together with such other use
incidental thereto. It is further mutually agreed and understood as follows:
1. The cost of maintenance and repair of said water service line shall
be bom solely by Melrose, his heirs, successors or assigns.
2. In the event that Mekose, his heirs, successors or assigns shall
elect to install a new water service line at another location for Lot No 1 with
the consent of the Suffolk County Department of Health Services for said
installation, this easement shall automatically terminate and cease to exist
upon the occurrence of the new water service line being put into service.
3. Nothing contained herein shall obligate Melrose, his heirs,
successors or assigns to install a new water service line for said Lot No. 1.
TWO: The aforesaid easement shall be fifteen (15) feet in width, and
is hereby established and described as follows:
"ALL that certain plot piece or pamel of land situate, lying and being
at Greenport, Town of Southold, County of Suffolk and State of New York,
more particularly bounded and described as follows:
BEGINNING at a point on a curve at the intersection formed by the
westerly line of Main Road (NYS Rt 25) with the southerly line of
Albertson's Lane;
RUNNING THENCE from said point and place of beginning along a
curve to the left having a radius of 2896.79 feet along Main Road (NYS Rt
25) in a southwesterly direction a distance of 17.21 feet to a point;
THENCE North 87 degrees 24 minutes 30 seconds West a distance of
278.74 feet to a point and lands now or formerly of James Melrose;
THENCE North 02 degrees 35 minutes 30 seconds East a distance of
15.00 feet to a point and the southerly line of Albertson's Lane;
THENCE along the southerly line of Albertson's Lane South 87
degrees 24 minutes 30 seconds East a distance of 287.17 feet to the point
and place of BEGINNING.
THREE: The creation of this easement is for the sole benefit of
Melrose and his respective heirs, executors, administrators, successors and
assigns. This easement does not create any rights to anyone else
whatsoever.
FOUR: This easement replaces an incorrect easement filed under
liber 12154 at page 121.
IT IS MUTUALLY COVENANTED AND AGREED by the parties
that this agreement shall run with the land and be binding upon and inure to
the benefit of the respective heirs, executors, administrators, successors and
assigns of each of the parties.
IN WITNESS WHEREOF, the parties have set their hands on the
day and year written above.
