ROSS, residing at ! 1850 Country Club Drive TT Cutchogue, NY 11935 party of the first part, and - DAVID ARTHUR ROSS , residing at 68 Dubois Street Darien, CT 06820 party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Mattimck, Town of Southold, County of Suffolk and State of New York, heretofore described in a certain deed granting said parcel to Helen Marguerite Goldsmith from Annie S.R. Wickham duly recorded in the Office of the Clerk of Suffolk County on December 4, 1929 in Liber 1472 at pages 107, 108 and 109, together with all that adjoining parcel of land heretofore described in a certain deed granting said parcel to H. Marguerite Goldsmith from Sheila A. Goldsmith Stroh duly recorded in the Office of the Clerk of Suffolk County on July 24, 1947 in Liber 2731 at pages 449, 450, 451 and 452 subject to all Covenants and Restrictions and rights of way set forth in both aforementioned deeds. SUBJECT TO the burdens of the terminable easement of right of way recorded in the Office of the Clerk of Suffolk County on October 25, 1994 at Liber 11699 page 843. TOGETHER WITH the benefit of the well easement recorded in the Office of the Clerk of Suffolk County on March 24, 1995 at Liber 11719 page 301. TOGETHER with all right, title .and interest, if any, of the party of the first part in and to lands under the waters of Peconic Bay. SUBJECT TO the burdens and together with the benefits of all covenants, restrictions, easements of rights of way, agreements, reservations and zoning regulations of record, if any, affecting the said premises. Dist. 1000 Sec. 123.00 Block BEING AND INTENDED TO BE the same premises described in the deed of the parties of the first part herein by deed 08.00 from MARGUERITE GOLDSMITH, dated August 31, 1961, recorded in the Suffolk County Clerk's Office on September Lot : 024.001 i, 1961, in Liber 5043, Page 485. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the patty of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of pitying the cost of the improvement and will apply the same first to the payment of the cost of improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
