THIS INDENTURE., made the 14th day of January, Two Thousand Two
BETWEEN
MICHAEL J. GUNNISON, TRUSTEE OF THE ALICE G. O'BRIEN REVOCABLE TRUST
DATED AUGUST 14, 2000, residing at 5 Nesbitt Drive, Bow, New Hampshire 03304,
party of the first part, and
MARK GORDON and ELLIE GORDON, husband and wife, residing at 146 Central Park West,
Apt. 24E, New York, New York 10023,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Arshamomaque, Town of Southold, County of Suffolk and
State of New York, known and designated as Lot 20 and the northerly 35 feet of Lot 21 on a
certain map entitled "Amended Map A Peconic Bay Estates", and filed in the Office of the
Clerk of the County of Suffolk on May/9, 1933 as Map No. 1124; said lot and part of lot when
taken together are more particularly bounded and described as follows:
BEGINNING at a point on the northeasterly side of Bay Shore Road where the same is
intersected by land now or formerly of Helen E. Oliver & Katherine L. Oliver; said point or
place of beginning being also distant 151.70 feet southeasterly as measured along the
northeasterly side of Bay Shore Road from its intersection with land now or formerly of the
Town of Southold un-named road;
RUNNING THENCE from said point of beginning alOng land now or formerly of Helen E.
Oliver and Katherine L. Oliver North 45 degrees 47 minutes 20 seconds East 194.01 feet to
the mean high water mark of Pipes Cove;
THENCE along the mean high water mark of Pipes Cove along a tie line the following two
courses and distances:
South 18 degrees 54 minutes 41 seconds East 55.30 feet;
South 24 degrees 46 minutes 13 seconds East 37.12 feet to land now or formerly of
Annette Golden;
THENCE along said last mentioned land South 45 degrees 47 minutes 20 seconds West 158.02
feet to the northeasterly side of Bay Shore Road;
THENCE along the northeasterly side of Bay Shore Road North 44 degrees 12 minutes 30
seconds West 85.00 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from Alice G. O'Brien, dated August 14, 2000, and recorded in the Office of the Suffolk
County Clerk.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.
