York, being more particularly bounded and described as follows:

of a line having a length of 167.32 feet, said line connects the northwesterly side of Kenvin
Boulevard with the northerly side of Bayshore Road;
RUNNING THENCE from said point or place of beginning along the northeasterly side of
Kerwin Boulevard, North 34 degrees :59 minutes West, 308.66 feet to land now or formerly of
Fucha;
THENCE North 47 degrees 17 minutes O0 seconds East along last mentioned land, 472.68 feet
to mean high water mark of Pipes Creek;
THENCE the following five (5) courses and distances along Pipes Creek' to the land nOW or
formerly of Donald G. Price Ir. and Linda S. Price:
(1) South 42 degrees 03 minutes 40 seconds East, 59.65 feet to a point;
(2) South 73 degrees $9 minutes East, 45.74 feet to a point;
O) South 49 degrees 15 minutes 05 seconds East, 80.18 feet to a point;
(4) South 36 degrees 14 minutes East, 89.5.5 feet to a point;
(5) South 13 degrees 56 minutes 00 seconds East, ! 15.08 feet to a point;
THENCE South 16 degrees 54 minutes West along last mentioned land, 330.07 feet to the
northerly side of Bay Shore Road;
THENCE South 79 degrees 54 minutes West along the northerly side of Bay Shore Road,
147.33 feet to the southeasterly end of the line first above mentioned:
THENCE North 68 degrees 22 minutes 50 seconds West. 166.32 feet to the point or place of
BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the pan'y of the first part by
deed f~om William A. Osterholm, dated February 28, 1986, and recorded March 27, 1986, in
the Office of the Suffolk County Clerk in Liber 10005, Page 493.
TOGETHER with all right, title and interesl, if any, of the pnrty o£the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appuflenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party oftbe second
part, the heirs or successors and assigns of thc party of the second part forever.
AND thc party of thc first part covenants that the party of the first part has not done or suffered
anything wbereby the said premises have been encumbered in any way whatevcr, cxccpt as
aforesaid.
AND the party el'the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the ennsidemtion for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose et'paying the
cost o1' the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total el'the same t'or any othcr purpose.
The word "party" shall be construed as if it read part es whenever thc sense ofth,s ~ndenture so
requires.
