Hall, C.E., August 1909, arra which said map is on file in the Office of the Clerk of the County of Suffolk, filed 12/1/1909 as Map 369, vhhich said lot is bounded and described as folloas: BEGINNING at a point on the easterly side of Ninth Street (Cherry Lane) at a point on said easterly side of Ninth Street where the division line between lots 3 and 4, as shown on said map, intersects sane and from said point of beginning; running thence North 12° 12' 10" Fast, along said easterly side of Ninth Street, 56.46 feet to the division line between lots 4 and 5, as shown on said map; thence South 82° 45' 10" East, along said division line last mentioned, 100.30 feet; thence South 6° 53' 30" West, 56.26 feet to the division line between lots 3 and 4, as shown on said map; thence North 820 44' 40" West, along said division line last mentioned, 105.52 feet to the easterly side of Ninth Street, at the point or place of BEGINNING. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
