W1TNESSETH, that the party of the first part, Io whom letters testamentary were issued by the
Surrogate's Court, Suffolk County, New York on March 17, 200:5 (File No. 4:53P200:5) and by virtue of
the power and authority given in and by said last will and testament and/or by Article 1 ! of thc F~tatcs,
Powers and Trusts Law, and in consideration of ONE MILLION ONE HUNDRED FORTY
THOUSAND ($1,140,000.00) DOI tARS, paid by [he party of thc second part, does hereby grant and
release unto the patty of the second part. the di~fibuteea or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land with the buildings and improvements thereon erected,
situate, lying and being at Southold, Town of Southold, County of Suffolk and State of N¢'w York, being
bounded and described as follows:
BEGINNING at a point on the northerly line of Main Road (S.R. 25) where the southwest comer of the
.premises to be described and the southeast comer of land now or formerly of Pura and William Capone
,ntersect the said not'dmerly line of Main Road;
RUNNING THENCE North 16 degrees 20 minutes 50 seconds West along land now or formerly of Pura
and William Capone, 175.16 feet to land now or formerly of Joseph and Marilyn Kmkowski;
THENCE along said last mentioned land, North 1:5 degrees 34 minutes 20 seconds West, 692.34 feet to
thc Long Island Rail Road;
THENCE North 70 degre~ 48 minutes 15 seconds East 'along the Long Island Rail Road, 453.21 feet to
land now or formerly of Francis Blakely. Joseph Kmkowski and Lillian Kmkowski;
THENCE along said last mentioned land. South 1 5 degrees O1 minute 30 seconds East. 73 1.40 feet to
the northerly line of Main Road:
THENCE South 54 degrees Ol minute 30 seeomls West along the northerly line of Main Road, 472.61
feet to the point or place of BEGINNING.
TOGETHER with ail right, title and interest, if any. of thc party of the first part in and to any streets and
roads abutting the above described premises to the center line thereof.
TOGETHER with the appurtenances, and also the estate which the said decedent had at the time of
dccedent's death in said premises, and also the estate therein, which the pa~y of the first pa~ has or has
the power to convey or dispose of, whether individually, or by vi~u¢ of said will or otherwise.
TO HAVE AND TO HOLD the premises herein grained unto the parly of the second part. the
distributees or successors and assigns of the par~y of the second part forever.
AND the pa~y of the first part covenants that the party of the first pa~ has not done or suffered anything
whe~by the said premises have been incumbered in any way whatever, except as aforesaid.
AND the patxy of the first part, in compliance with Section I 3 of the Lien Law, covenams that the party
of the first part will receive the consideration for this conveyance and will hold the fight to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of improvement and
will apply same first to the payment of the cost of improvemem before using any pa~ of the tolal of the
same for any other purpose.
The word 'party" shall be construed as if it reads ~parties' whenever the sense of this indcnlure so
requires.
