lawful money of the United States paid by the party of the second part, does hereby grant and release unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever,

Little Hog Neck, in the Town of Southold, County of Suffolk, and State of New York, known and
designated as "Fisherman's Beach", Lot 12 on a certain map entitled, "Subdivision Map, Peconic Bay
Properties Inc., surveyed February 6, 1931, by Otto W. Van Tuyl, Surveyor", and filed in the Office of the
Clerk of the County of Suffolk April 15, 1931, as Map No. 786 of Maps, said lot being more particularly
bounded and described as follows:
BEGINNING at a point on the southerly side of Haywaters Road where the same is intersected by
the division line between Lots I 1 & 12, said point or place of beginning also being at the north east corner of
premises herein to be described;
RUNNING THENCE from said point or place of beginning along the division line first above
mentioned south 38 degrees 27 minutes 10 seconds west 282.58 feet to Cutchogue Harbor;
RUNNING THENCE along the mean high water mark of Cutchogue Harbor the following tie line
course and distance;
North 55 degrees 27 minutes 16 seconds west 81.20 feet to the division line between lots 12 & 13;
RUNNING THENCE along said division line north 41 degrees 41 minutes 50 seconds east 284.84
feet to the southerly side of Haywaters Road; and
THENCE along the southerly side of Haywaters Road South 54 degrees 50 minutes 10 seconds east
65.00 feet to the point or place of BEGINNING.

Properties Inc., surveyed February 6, 1931, by Otto W. Van Tuyl, Surveyor", and filed in the Office of the
Clerk of the County of Suffolk April 15, 1931, as Map No. 786 of Maps, said lot being more particularly
bounded and described as follows:

BEGINNING at a point on the northerly side of Haywaters Road where the same is intersected by
the division line between lots 23 and 24 as shown on the aforesaid map said point or place of beginning
being at the southwest corner of premises herein to be described;
RUNNING THENCE from said point or place of beginning along the division line first above
mentioned north 30 degrees 09 minutes 50 seconds east 54.59 feet to Haywaters Cove;
RUNNING THENCE along Haywaters Cove the following tie line course and distance: South 75
degrees 23 minutes 02 seconds east 75.31 feet to the division line between lots 24 & 25;
RUNNING THENCE along said division line south 32 degrees 09 minutes 50 seconds west 80.93
feet to the northerly side of Haywaters Road, and
THENCE along the northerly side of Haywaters Road north 54 degrees 50 minutes 10 seconds west
70.00 feet to the point or place of BEGINNING.
TOGETHER with all the right, title and interest of the party of the first part of, in and to the lands
under water known as Cutchogue Harbor and Haywaters Cove in front of and adjacent to the above-
described premises.
TOGETHER with all the right, title and interest of the party of the first part of, in and to Haywaters
Road in front of and adjacent to said premises.
TOGETHER with an easement over the southwesterly five (5) feet (adjacent to Haywaters Road) of
lots 25, 26, 27, 29, 30, 32 and 33 for an underground water pipe line.
SUBJECT TO DECLARATION made the 5`s day of November, 1976 by JOSEPH GOLD and
JANET GOLD, his wife, both residing at 250 Park Avenue, Freeport, New York, 11520, hereinafter called
the "Declarants"
WHEREAS the Declarants are now or will be the record owners of the above premises;
AND WHEREAS the Declarants have obtained permission from a nearby landowner to maintain a
well point for the purposes of obtaining potable domestic water to the above described premises, and
WHEREAS, the Suffolk Department of Health has refused without a written waiver from the
Declarants, to approve the above described premises for a health permit to erect a one-family dwelling due
to the lack of municipal water supply system serving the premises and the lack of potable water on the
premises;
NOW, THEREFORE, THIS DECLARATION WITNESSETH:
The Declarants in full knowledge of the existing status of the water supply on the above described
premises, upon the receipt of a waiver of the existing Suffolk County Department of Health standards for
potable water, agree to relieve Suffolk County Department of Health of any responsibility or obligation to
provide a safe potable water supply to the above described premises.
This Declaration shall be a covenant running with the land and shall be binding upon the Declarants,
their successors and assigns.
BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by
deed dated November 5, 1976 recorded in the Office of the Clerk of the County of Suffolk on November 16,
1976 in Liber 8142 at page 177.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
