DEED
THIS INDENTURE made the2X th day ofA'- a-- ,. 1997 between

10128 GRANTOR, and
JOSEPHINE A. KIRSCH, residing at 1217 Park Avenue, New York, New .
York, 10128, GRANTEE:
WITNESSETH:
That the Grantor, in consideration of Ten Dollars ($10.00) ,
lawful money of the United States, and other good and valuable
consideration, paid by Grantee, does hereby grant and release unto
Grantee, the heirs, successors and assigns of Grantee forever, all
of the Grantor's interest in:
ALL that certain plot, piece or parcel of real property with
the buildings thereon erected, situate, lying and being near
Greenport, in the Town of Southold, County of Suffolk, State of New
York, bounded and described as follows:
BEGINNING at a point on the ordinary high water mark of Pipes
Cove, S. 86'31' E.-39.14 feet and then S. 67'18140" E.-215.46 feet
along the high water mark from the southeasterly corner of land of
Nelson; from said point of beginning running thence along said land
of the party of the .first part, three courses:
(1) N. 90.45120" E. - 425.0 feet, thence
(2) S. 67.18140" E. - 102.60 feet; thence
(3) S. 9.45120" W. 425.0 feet to said high water mark of
Pipes Cove; thence along said high water mark N. 67. 18 ' 40"
W.- 102.60 feet to the point of beginning.
TOGETHER with a right of way described as follows:
BEGINNING at a monument at the southerly terminus of the
easterly line of Ninth Street; from said point of beginning running
along said easterly line of Ninth Street, N. 12. 12 ' 10" E. - 86.0
feet; thence the following six courses:
(1) S. 82' 44 ' 30" E. - 22.40 feet; thence
(2) S. 7. 00' E. - 115.52 feet; thence

(4) S. 9. 45' 20" W. - 51.30 feet; thence
(5) N. 67. 18 ' 40" W. - 430.92 feet; thence
(6) N. 7. 00' W. - 68.87 feet to the point of beginning.
SUBJECT to a 50 foot right of way across the northerly 50 feet
of the premises.
SAID PREMISES are also known as and designated as street
number 1850 ninth Street, Greenport, New York.
SUBJECT to easements and restrictions of record, if any.
SUBJECT to state of facts an accurate survey may reveal.
TOGETHER with all right, title and interest,if any, of the
Grantor in and to any streets and roads abutting the above
described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights
of the Grantor in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the
Grantee, the h6irs or successors and assigns of the Grantee
forever.
AND the Grantor covenants that he has not done or suffered
anything whereby the said premises have been encumbered in any way
whatsoever, except as aforesaid.
Being the same premises conveyed to the Grantor in deed dated
May 31, 1972 and recorded in liber of deeds 7171 at page 106 in the
Office of the Clerk of Suffolk County.
AND the Grantor, in compliance with Section 13 of the Lien
Law, covenants that he will receive the consideration for this
conveyance and will hold the right to receive such consideration as
a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of
