Party ofthe second part,
WITNESSETH, that the party of the first part, in consideration ofTEN ($10.00) dollars,
lawful money of the United States paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Greenport, in the Town of Southold, County of Suffolk, and
State of New York, bounded and described as follows:
PARCEL I
BEGINNING at a monument on the easterly boundary line of land of William H. Braun and
Robertina Braun, his Wife, at the point where said boundary line is intersected by the northerly line
of a 50 foot private road known as "Clerk Street" said monument being North 82 degrees 48
minutes West, 167.90 feet along said northerly line of Sixth Street, from said point of beginning;
RUNNING along the direct extension southerly of said easterly boundary line, South 06 degrees 56
minutes 50 seconds West, 12.50 feet to an iron pipe on the northerly line ora 25 foot private road;
THENCE along said northerly line of said 25 foot private road, North 83 degrees 03 minutes 10
seconds West, 87.50 feet to an iron pipe on the easterly side of said 25 foot private road;
THENCE along said easterly line, North 06 degrees 56 minutes 50 seconds East, t00.0 feet to an
iron pipe;
THENCE along said land of Braun, two courses as follows: (1) Nomh 41 degrees 06 minutes 30
seconds East, 84.60 feet to an iron pipe; (2) South 83 degrees 03 minutes 10 seconds East, 40.0 feet
to an iron pipe on said easterly boundary line;
THENCE along said easterly boundary line, South 06 degrees 56 minutes 50 seconds West, 157.50
feet to the point of beginning.
PARCEL II
BEGINNING at an iron pipe on the northerly line of said 25 foot private road at the southeasterly
comer of Parcel I, hereinabove described;
RUNNING THENCE South 06 degrees 56 minutes 5'0 seconds West, 12.50 feet to the center line of
said 25 foot private road;
THENCE along said center line, two courses as follows: (1) North 83 degrees 08 minutes 10
seconds West, 100.0 feet; (2) North 06 degrees 56 minutes 50 seconds West, 100.0 feet;
THENCE North 51 degrees 56 minutes 50 seconds East; 17.68 feet to said easterly line of said 25
foot private road;
THENCE along said easterly line South 06 degrees 56 minutes 50 seconds West, 100.0 feet to said
northerly line of said 25 foot private road;
THENCE along said northerly line, South 83 degrees 03 minutes 10 seconds East, 87.50 feet to the
point of BEGINNING.
The above described Parcel II subject to its use as a right of way.
TOGETHER with a right of way 12.5 feet wide along the westerly and southerly boundaries of
Parcel II.
ALSO WITH a right of way 50 feet wide from the premises easterly to Sixth Street, the northerly
line of said 50 foot fight of way beginning at the point of begiuning of Parcel I, hereinabove
described, and running South 82 degrees 48 minutes East, 167.90 feet to the westerly line of Sixth
Street and the southerly line of said 50 foot fight of way being parallel to and 50 feet southerly
therefrom measured at right angles:
PARCEL III - an undivided 1/16 interest
BEGINNING at an iron pipe at the westerly terminus of the curved southerly line of the easterly
branch of a 25 foot private road adjoining land now or formerly of Loomis, from said point of
beginning;
RUNNING easterly along said curved southerly line on a curve to the left, having a radius of 47.50
feet, a distance of 49.31 feet;
THENCE along land now or formerly of Braun, two courses: (1) South 25 degrees 44 minutes 30
seconds East, 73.47 feet; (2) South 47 degrees 13 minutes 20 seconds West, 130.38 feet to ordinary
high water mark of Pipes Cove as found in 1955;
THENCE along said high water mark, North 56 degrees 16 minutes 30 seconds West, 72.91 feet to
said land now or formerly of Loomis;
THENCE along said land now or formerly of Loomis, North 33 degrees 43 minutes 30 seconds
East, 140.23 feet to the point or place of BEGINNING.
PARCEL IV - an undivided 1/16 interest
BEGINNING at the point of beginning of Parcel III hereinabove described;
RUNNING THENCE along said land now or formerly of Loomis, North 33 degrees 43 minutes 30
seconds East, 12.50 feet to the center line of said 25 foot private road;
THENCE easterly along said center line on a curve to the left having a radius of 35.0 feet a distance
of 36.34 feet;
THENCE South 25 degrees 44 minutes 30 seconds East, 12.50 feet to said northerly line;
THENCE westerly along said southerly line ora curve to the right, having a radius of 47.50 feet a
distance of 49.31 feet to the point of BEGINNING.
PARCEL IV subject to its use as a right of way. Together with a right of way 12.50 feet wide along
the northwesterly boundary of said Parcel IV.
TOGETHER WITH a right of way 25 feet wide from the northeasterly corner of Parcel III northerly
about 360 feet and then easterly about 88 feet to a 50 foot right of way.
THENCE continuing easterly over said 50 foot right of way about 168 feet to Sixth Street.
BE1NG AND INTENDED TO BE the same premises conveyed to the parties of the first part by
deed dated August 29, 1997 recorded in the Office of the Clerk of the County of Suffolk on
September 19, 1997 ih Liber 11852 page 811.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and
to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,' the heirs
or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been incumbered in any way whatever, except as
aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the
improvement, and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose. The word "party" shall be construed as
~f~t read part~es whenever the sense ofthts indenture so requires.
