Southold, New York 11971, party of the second part.

and State of New York, known and designated as the seutherly two-thirds of Lot Numbered 4 on a certain
map entitled ~Map of Subdlvlsidn known as Kennewcoo~ made by Otto w. VanTuyl & Son, Ucensed Land
Surveyors, dated .lanuan/9, 1.954, and filed In the Suffolk County Oerk's office on Man:h 30, 1.954 as Map
#2180; said premises being bounded on the East by Kenney's Road a distance of .50 feet; on the South by Lot
Numbered 3 on said map a distance of 153.69 feet; on the West by land of Robert Malone, individually and as
Trustee of Malone Trust A, a distance of 50 feet, and on the North by the southerly line of the northerly one-
third of said Lot Numbered 4.
SUB3ECT to a right of way 25 feet In width for the benefit of lands of the party of the second part to the West,
consisting of two parcels known as SCTH #1.000-59-7-25 and SCTM #1000-59-7-28,
SUBJECT to the same Covenants and Restrictions as set forth In Uber 3822 of deeds at page 74.
BEING AND INTENDED TO BE the same premises as conveyed to the party of the f'mmt part by deed dated
.lanuary 8, 1.983 and resorded in the Suffolk County Clerk's offk:e on Wlay 6, 1.983 in Llber 9355, page 5.
TOGETHER with all ~ight. title and interest, if any, of the party of the first part in and to any sb'eets and roads

the estate and rights of the party of the flint part in end to said premises; TO HAVE AND TO HOLe the
premises herein granted unto the party of the second part, the heirs or sucoessere and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffersd anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the IJen Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hoid the right to receive such consideration
se a trust fund to he applied flint for the purpose of paying the cost of the improvement and will al~ly the same
first to the payment el' the cost of the improvement before using any part of the total of the same for any other
purpc~e. The word "party' shall be construed as If it read 'parties' when ever the sense of this indenture so
requires.
