This Indenture, made the /~ day of
Thousand and Eight,
BETWEEN
THE ULMET QUALIFIED PERSONAL RESIDENCE TRUST #I, under
agreement dated May 8, 2007, Maria L. Ulmet, residing at
4600 Ole Jule Lane, Mattituck, New York 11952, as
Trustee, as to a one-half interest in the premises;
party of the first part, and
and THE WARREN W. ULMET REVOCABLE TRUST, under agreement
dated December 5, 2006, Maria L. Ulmet, residing at 4600
Ole Jule Lane, Mattituck, New York 11952, as Trustee;
party of the second part,
WITNESSETH, that the party of the first part, in
consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does
hereby grant and release quitclaim unto the party of the
second part, the heirs or successors and assigns of the
party of the second part forever, all of the party of
the first part's interest in
ALL that certain plot, piece or parcel of land, with
buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, at Mattituck,
County of Suffolk and State of New York, and being more
fully bounded and described as follows:
BEGINNING at a locust post set on that course of
the easterly line of Ole Jule Lane, which runs North 2
degrees 35 minutes 10 seconds East, a distance of 427.56
feet southerly as measured along said easterly line of
Ole Jule Lane from its intersection with the southerly
line of Kraus Road;
RUNNING THENCE along said easterly line of Ole Jule
Lane North 2 degrees 35 minutes 10 seconds East a
distance of 75 feet to a locust post;
THENCE along land of Schiller South 64 degrees 25
minutes 50 seconds East, a distance of 290 feet to a
point 10 feet easterly from the westerly edge of a
dredged canal;
THENCE in a general southerly direction on a line
10 feet easterly from said westerly edge of said dredged
canal, a distance of 120 feet;
THENCE along land of Schwefel, North 52 degrees 56
minutes 50 minutes West, a distance of 266 feet to the
point or place of BEGINNING.
TOGETHER with all the right, title and interest of
the party of the first part, if any, in and to Ole Jule
Lane in front of and adjacent to the above described
premises to the center line thereof.
TOGETHER with a Right of Way, if any, over a
certain 25 foot private road leading from the southerly
line of New Suffolk Avenue southerly to Peconic Bay.
TOGETHER with a free and unobstructed use of the
channel lying in front of and adjacent to said premises.
SUBJECT to Covenants & Restrictions in Liber 4296
cp 121.
BEING AND INTENDED TO BE the same premises conveyed to
the Grantor by Deed dated May 8, 2007 and recorded in
the Suffolk County Clerk's Office on May 22, 2007 in
Liber 12506 page 207, the Grantor being the same person
described as one of the Grantees in said Deed.
Together with all right, title and interest, if any, of
the party of the first part in and to any streets and
roads abutting the above-described premises to the
center lines thereof;
Together with the appurtenances and all the estate and
rights of the party of the first part in and to said
premises;
To have and to hold the premises herein granted unto the
party of the second part, the heirs or successors and
assigns of the party of the second part forever.
And the party of the first part covenants that the party
of the first part has not done or suffered anything
whereby the said premises have been encumbered in any
way whatever, except as aforesaid.
And the party of the first part, in compliance with
Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this
conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for
the purpose of paying the cost of improvement and will
apply the same first to the payment of the cost of the
improvement before using any part of the total of the
same for any other purpose. The word "party" shall be
construed as if it read "parties" whenever the sense of
this indenture so requires.
In Witness Whereof, the party of the first part has duly
executed this Deed the day and year first above written.
