BETWEEN, FRANK L. ROESSLE and CHARLOTTE M. ROESSLE, his wife, both residing at 70 Oak
Street, Northport, New York 11768,
party of the first part, and
FRANK L. ROESSLE, residing at 70 Oak Street, Northport, New York 11768,
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Cutchogue, in the Town of Southold, County of Suffolk, and State of New York, which, on a
certain map entitled, "Map of Eugene Heights owned by Jacob F. Bowers, situate at Cutchogue, New York,"
and filed in the Office of the Clerk of the County of Suffolk on October 29, 1928, under file No. 856, are known
and designated as and by part of Lot Nos. 30 and 31, being more particularly bounded and described as follows:
BEGINNING at a point on the Easterly side of Oak Street where the same is intersected by the division line
between lots 31 and' 32 on the aforesaid map said point or place of beginning being also distant 280.72 feet
southerly as measured along the Easterly side of Oak Street from the corner formed by the intersection of the
Southerly side of Pierce Drive with the Easterly side of Oak Street;
Running thence from said point or place of beginning along said division line North 82 degrees 01 minutes 10
seconds East 172.0 feet to the mean high water mark of Eugene's Creek;
Thence along the mean high water mark of EugeHe's Creek on a tie line South 32 degrees 03 minutes West
65.30 feet to the divisioH line between lots 29 and 30;
Thence along said last mentioned division line South 82 degrees 01 minutes 10 seconds West 130.0 feet to the
Easterly side of Oak Street;
And Thence along the Easterly side of Oak Street North 7 degrees 58 minutes 50 seconds West 50.0 feet to the
point or place of BeginniHg.
BEING AND INTENDED TO BE the same premises described in a deed to the party of the first part herein by deed
from Henry O. Kruger, dated July 21, 1975, and recorded July 25, 1975 in Liber 7880 Page 488 in the Office of the
Suffolk County Clerk.
TOGETHER ~vitb all right, title and interest, if any, of the party of the first part iu and to any streets aod roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever.
AND the party of the first part covenants that the part3, of the first part has not done or suffered anythiHg
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purposes.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
