as tenants in common without right of survivorship
party of the second part,
WITNESSETH, that the party of the first part, in consideration of ten ($10.00) dollars paid by the party of the second
part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the
party of the second part forever,
ALL that certain plot. piece or pamel of land, with the buildings and improvements thereon erected, situate, lyihg
and being at Mattituck, in the Town of Southold, County of Suffolk and State of New York, known and designated
as Lot No. 7 on a certain map entitled, "Map of Bennett's Pond, at Mattituck, Town of Southold, Suffolk County,
New York" filed in the office of the Clerk of the County (~f Suffolk on June 12, 1970, as Map No. 5483.
TOGETHER WITH an undivided one-tenth (1/10th) interest in two strips of land shown and designated as "Park"
on the "Map of Bennett's Pond" filed in the office of the Clerk of the County of Suffolk on June 12, 1970, as Map
No. 5483. SUBJECT TO a maintenance charge not to exceed $10.00 in any one calendar year for the upkeep of
said park areas.
TOGETHER WITH a right of way of ingress and egress and for public utility easements over proposed roads to
and from the subject premises as shown on the "Map 'of Bennett's Pond" filed in the office of the Clerk of the
County of Suffolk on June 12, 1970, as Map No. 5483, to the nearest public highway. The party of the first part
reserves the fee to said proposed roads for the purpose of their dedication to the Town of Southold as public
highways.
SUBJECT TO covenants and restrictions of record.
RESERVING HOWEVER, a legal life estate, in and to the subject premises, together with the buildings and
improvements thereon erected, to the party of the first part, ALEX H. ZANIESKI, JR., and JOAN ZANIESKI,
husband and wife.
Premises known as 700 Bennett's Pond Lane, Mattituck, New York and designated as District 1000 Section 113
Block 13 Lot 7 as shown on the Suffolk County Land and Tax Map.
BEING AND INTENDED TO BE the same Idremises conveyed by deed dated 6/3/1971 and recorded on 8/9/1971 .
in Libor 6944 at Page 163.
TOGETHER with all right, title and interest, if any, of the party of t~e first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AN D TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and ~vill hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose. The
word "party" shall be construed as if it read "parties" when ever the ~ense of this indenture so requires.
