THIS INDENTURE, made the 28t~day of August, two thousand eight
BETWEEN MILDRED C. MARTIN, residing at 38 Hunt Farm Road, Waccabuc, New
York 10597, as Executrix of the last will and testament of LEE M. J.
MARTIN, late of Cutchogue, Town of Southold, Suffolk County, New York,
deceased, party of the first part, and
MILISSA J. MARTIN, residing at 38 Hunt Farm Road, Waccabuc, New York 10597,
and CANDACE J. CLATTkRBUCK, residing at 6294 Dillon's Mill Road, Callaway,
Virginia 24067, Co-Trustees of the By-Pass Credit Trust under the Will
of LEE M. J. MARTIN for the benefit of MILDRED C. MARTIN, party of the
second part
WITNESSETH, that whereas letters testamenta'~ry were issued~ to the party of the first
part by the Surrogate's Court, Suffolk County; New York, oh' May 1;~2008 and by virtue of
the power and authority given in and by said last.will and testament,"and/or by Article 11
of the Estates, Powers and Trusts Law, and in consideration of NO Dollars, paid by the party
of the second part, does hereby grant and release unto the party of the second part, the
distributees or successors and assigns of ~hepartyof the second part forever, all its interest
in and to
ALL that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate, lying and being in the Town of
Southold, at Cutchogue, known and designated as Lot Number Three (3) on
a certain map entitled, "Map of Fairway Farms", and filed %n the Office
of the Suffolk County Clerk on February 15, 1974 as Map Number 6066.
SUBJECT TO the Covenants and Restrictions. recorded in the Office of the
Suffolk County Clerk on February 22, 1974 in Liber 7593 at Page 34.
SUBJECT TO an Easement 6f"~ngre~s and Egress granted by Deed recorded
on November 11, 1971 in L'i~er ~045 at Page 393.
The party of the second part hereby covenants and agrees to keep the
above-mentioned Easement open and free from obstructions; and to maintain
said Easement in a well paved condition, the cost to be shared on a pro-rata
basis with others having access from Praity Lane.
BEING AND INTENDED TO BE the same premises conveyed to Lee M.J. Martin
by deed dated May 2, 1997 and recorded in the Office of the Clerk of the
County of Suffolk on May .6, 1997 in Liber 11829 at page 123.
TOGETHER with all right, title and interest, if any, of the party of the first part in and
to any streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and also all the estate which the said decedent had at the
time of decedent's death in said premises, and also the estate therein, which the party of
the first part has or has power to convey or dispose of, whether individually, or by virtue
of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party
of the second part, the distributees or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said .premises have been encumbered in any way whatever, except
as aforesaid.
subject to the trust fund provisions of Section 13 of the Lien Law.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture
so requires,
