Y. THIS INDENTURE, made theday of nineteen hundred and "'forty-one , between SARA L. HYATT, of Greenport, Suffolk County, New York, I I� part y of the first: part, II' and TOWN OF SOUTHOLD, a municipal corporation with its principal office and l place of business at Greenport, Town of Southold, County of Suffolk end State of New York, part y of the second part, WITNESSETH, that the part y of the first part, in consideration of ---------------ONS (11.00)------------------------Dtilltu E, lawful money of the United States, paid by the part y of the second part, do as hereby grant and release unto the party of the second part, Its successors and assigns forever, ALL those tracts or parcels of land situate near Hortonls Point, Town of Southold, County of Suffolk and State of New York, bounded and described as follows:- PARCEL ONE:. BEGINNING at a point on ordinary high water line of Long Island Sound at the northeasterly line of Hortonls Lane as recently altered (or about to be altered) and running thence northeasterly along said ordinary high water mark of i Long Island Sound, 120.5 feet to land of Sar a• L. Hyatt; thence on a line parallel to said northeasterly line of Hortonls Lane, S. 56029140"E.- 350 feet, more or less, to a point on the next to last course of the northerly line of said Hortonls Lane I I II as altered; thence along the last described course of Hortonls Lane, S. 33030120" 120.5 feet to a right angle turn in said line; thence along the northeasterly line of Hortonls Lane, N. 560 E91 40" Ii.- 350 feet, more or less, to said ordinary high water line of Long Island Sound. Together with all right, title and interest of the party of the first part in I and to Long Island Sound in front of and adjacent to said premises. PARCEL T9V0:- BEGINNING at the right angle turn in the southerly line of Hortonls Lane as recently altered (or about to be altered) and on the line between land of Sa.r a, L. Hyatt and land now or formerly of Rosalie Jones; running thence along the southeasterly line of Hortonls Lane, N. 330 301 2011 E.- 50 feet; thence along other ladd of said S.a r a L, Myatt, S. 560 291 40" E.- about 90 feet to the shore of Little Pond (or Lily Pond); thence southwesterly along said a.hore of Little Pond about 50 feet to land now or formerly of Rosalie Jones; thence along said land now or formerly of Rosalie Jones, N. 560 29' 40" W. about 90 feet to the point of � beginning. Together with all right, title and interest of said party of the first part 50 feet in width In said Little Pond Ding/between the direct extension of the side lines of the herein deeds premises into said Little Pond. SUBJECT to the following restrictions and conditions:- 1. As to road: Township to receive title from Hyatt to Proposed road and Township to quitclaim and file certificate of abandonment as respects all of the present part of Hortonts Lane not included in proposed road. 2. Said premises are not to be used for any business purpose whatever but solely for park purposes and that no refreshment stands or other concessions shall be granted or permitted on said premises. 3. The party of the second part shall erect and maintain a fence of at least as good quality, construction and height as that at present employed in winter by the Township of Southold and commonly referred to as snow-fence for a period of six months annually beginning May let and ending on October 1st in each year. The course of said fencing shall commence at the mean high water mark of Long Island Sound :at the north- easterly corner of the premises herein described and run continously fro4 that point qF?�` along the easterly WM"V##M edge of said land and along the easterly and northerly edge of Horton s Lane as altered to the Point where same meets the boundary line se-parating land of W1altse,r^R.7if:y at t¢/J/ # from the property now or formerly owned by Overton. Openings in the fence for ingress and egress of owners of land adjacent to proposed road shall be granted,upon application,to any and all owners of record of said land.' - - These restrictions and conditions are to apply solely to the premises herein conveyed and are not binding as to any property now or hereafter owned by the party of the first part. The party of the .first part does for herself, her heirs, executors, administrators and assigns, reserve the right and privilege of altering and releasing any of the above res trietions� together with the appurtenances and all the estate and rights of the part y of the first part in and to said premises, TO HAVE AND TO HOLD the premises herein granted unto the part y of the second part, its successors and assigns forever i i The party of the first part covenants that if any improvements, repairs or alterations to the premises have been commenced and have not been completed at least four months before the recording of this deed, the Grantor will receive the consideration for this conveyance as a trust fund to be applied first for the purpose of paying the cost of improvement, and that said Grantor will apply the same first to the payment of the cost of improvement before using any part of the total of the same for any other purpose. AND said SARA L. HYATT I covenant s as follows: First. That said SARA L. HYATT IS seized of the said premises in fee simple, and ha s good right to convey the same; Second. That the part y of the second part shall quietly enjoy the said premises; Third. That the said premises are free from incumbrances I i Fourth. That the party of the first part will execute or procure any further necessary assurance of the title to said premises; Fifth. That said SARA L. HUTT will forever warrant the title to the said premises.
