THIS INDENTURE, made as of August 27, 2008 by and between
JOSEPH M. SCHUPLER and ALBERTA C. SCHUPLER, both residing at 7 Diamond Court, Huntington, New
York 11743, as tenants-by-the-entirety, party of the first part, and
JOSEPH M. SCHUPLER and ALBERTA C. s~HuPLER, both residing at 7 Diamond Court, Huntington, New
York 11743, as tenants-in-common each with an undivided one-half (1/2) interest, party of the second part,
WITNESSETH, that the party of the first part, in consideration often ($10.00) Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever, all of their right, title and interest in and
to:
All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and
being at Peconic, Town of Southold, County of Suffolk and State of New York, being more particularly bounded
and described as follows:
BEGINNING at a point on the easterly side of Wells Road where the same is intersected by the southerly boundary
line of land now or formerly of Kowalchuk, said point or place of beghming being distant 3431.90 feet southerly as
measured along the easterly side of Wells Road from the comer formed by the intersection of the easterly side of
Wells Road with the southerly side of Main Road (NYS route 25);
Running thence from said point or place of beginning along said last mentioned land of Kowalchuk North 89
degrees 35 minutes 50 seconds East 220 feet to the apparent ordinary high water mark of Richmond Creek;
Running thence along the ordinary high water mark of Richmond Creek in a general southerly direction a distance
of 175 feet more or less to land now or formerly of Dansker;
Running thence along said last mentioned land north 69 degrees 29 minutes 40 seconds west 154 feet to the easterly
side of Wells Road; and
Thence along the easterly side of Wells Road in a northerly direction along the arc of a curve bearing to the left
having a radius of 256.6 feet a distance of 93~64 feet to the point or place of beginning.
Being and intended to be the same premises described in the deed dated June 17, 1998 between Nancy Doris
DeLoiselle, Surviving Executrix of the Estate of Lura Kmeger, as Grantor, and Joseph M. Schupler and Alberta C.
Schupler, as Grantees, which deed was recorded in the Suffolk County Clerk's Office on July 2, 1998 in Liber
11902, Page 429.
Said premises is also known by the street address 3475 Wells Road, Peconic, New York 11598.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the fu'st part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the lb-st part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied fu'st for the purpose of paying the cost of the improvement and will apply the same In'st to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
