THIS INDENTURE, made the 8th day of October, Two Thousand Eight
BETWEEN
SAMANTHA KIRBY, residing at 3015 Skunk Lane, Cutchogue, New York 11935,
party of the first part, and
GREATPECONIC, LLC, whose address is c/o Salvatore Cervolo, 105-14 Metropolitan, Forest
Hills, New York 11375, party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the .party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Cutchogue, Town of Southold, County of Suffolk, and State of
New York, bounded and described as follows:
BEGINNING at the point of intersection of the southerly line of Le~lie's Road with the easterly
line of Skunk Lane;
RUNNING THENCE along Leslie's Road, North 57 degrees 01 minutes 50 seconds East, 142.60
feet to Lot No. 1 shown on "Map of Bay Homes" filed in the Suffolk County Clerk's Office as
Map No. 5723;
RUNNING THENCE along Lot No. 1, South 32 degrees 58 minutes 10 seconds East, 329.70
feet;
RUNNING THENCE South 55 degrees 20 minutes 30 seconds West, 158.79 feet to the easterly
line of Skunk Lane;
RUNNING THENCE along Skunk Lane two courses:
1. North 29 degrees 00 minutes 40 seconds West, 129.84 feet;
2. North 30 degrees 58 minutes 10 seconds West, 204.98 feet to the point of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 7/15/2004, and recorded 8/4/2004, in the Office of the Suffolk County Clerk in Liber
12335, Page 117.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

first above written.
