OFFICE OF THE CLERK OF THE COUNTY OF SUFFOLK ON JUNE 3, 2002 IN LINER 12189
PAGE 338 TO ADD A NOTICE COVENAI~F TO THE DEED DESCRIPTION CONCERNING
TIDAL WETLANDS AND TO CHANGE FORM OF OWNERSHIP FROM TENANTS IN
COMMON TO JOINT TENANTS.
TOGETHER with all right, title and interest, if any, of thc party of the first part in and Lo any streets and
roads abutting the above described premises to the center lines thereof.

ALL THAT CERTAIN PLOT, piece or parcel of lund, with thc buildings and improvements thereon
meted, situate, lying and being in thc Town of Southold, County of Suffolk and State of New York as
being Lots Nos. 19. 20, 21, 22, 23, 24, 25, 26, 27, including the parcel of land adjacent to Lots 23. 24. 25,
26 desiguated as "right of way", said lots and "right of way" being shown on a map entitled Subdivision of
Property of Lewis Homes Company, loc., situate al Arshamomaquc, Town of Southold, New York,
subdivided October 22, 1930, by Otto W. Van Tuyl, Licensed Surveyor, said map being filed as Map
Number 535 in the County Clerks Office of Suffolk County, December 8. 1930. 'All of said lots being part
of the same premises conveyed to Lewis Homes Company, Inc., by John H. Lehr and Florence H. Lchr, his
wife, by deed dated November 30, 1925, and recorded in the County Clerk's Office of Suffolk County of
January 22. 1926, in Liber 1101 of deeds, at page 292; Lots 22, 23.24. 25.26 and 27 and said "tight of
way" being the same premises conveyed by Lewis Homes, Inc. to William D. McLean by deed dated
January 3, 1931.
REGULATED TIDAL WETLANDS associated with Mill Creek are located at Main Road.
Southold, County Tax Map Number: District 1000, Section 56, Block 6, Lots 8.2, 8.7 and 9.2 previously
referred to as Lots 8.2, 8.4, 8, 9.1 otherwise known as the properties of Helen Reiter and her heirs, assigns.
or successors. This property is subject to the provisions of New York State Environmental Conservation
Law (ECL Article 25 or its successor, and thc conduct of regulated activities may occur only pursuant to
ECL Article 25 if prior approval is given by the New York State Department of Environmental
Conservation (NYSDEC) or its successor. Regulated aclivitics include, but are not limited to the erection
of any structu~(s); excavation; dredging, grading and filling; clearing of vegetation; and application of
chemicals.
AND the plirty oftbe first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 oftbe Lien Law, covenants that the party
of the first pan will receive the consideration for this conveyance and will hold the right to receive such
considereation as a trust fund to be applied first for the purpose of payi~ the cost of the improvement, and
will apply the same first to the payment ofthe cost of the improvement before using any part ortho total of
the same for any other ptupose. The word "party" shall be consu'ued as if it read "parties" whenever the
sense ofthis indenture so requires.
