PURCHASER BEFORE SIGNING.
THIS1NDENTURE, made the 3~ day of October, 2001,
between Marie Schlecht, as executor of the last will and testament of John A, Schlecht, late of 56425 North Road,
Southold, New York, 11971, who died on January 26, 2001, party of the first part, and
Thomas S chlecht of 155 Beckwith Avenue, New York, 11971, and Linda Kohut, 70 East 10th Street,
New York, New York, 10003, tenants in common,
party of the second part,
WITNESSETH, that the party of the first part, to whom letters testamentary were issued by the
Surrogate's Court, Suffolk County, New York on March 8, 2001 and by virtue of the power and
authority given in and by said last will and testament, and/or by Article 11 of the Estates, Powers and
Trusts Law, in accordance with the Last Will and Testament of John A. Schlecht and in consideration of
0.00 dollars, lawful money of the United States, paid by the party of the second part, does hereby grant
and release unto the party of the second part, the distributees or successors and assigns of the party of
the second part forever,
AN UNDIVIDED 81.25% that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate, lying and being in the
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at or near Arshamomoque, in the Town of Southold, County of Suffolk and
State of New York, bounded on the East by lands now or formerly of Frank P.Rink and Lillian R.
Hollmann; on the North by the Long Island Sound; on the West by land now or formerly of George P.
Lederle, and on the South by the North Road; said parcel measuring 100 feet along NorthRoad, the
westerly line being 1000 feet east from the easterly line of land formerly of William Arnott, as measured
along the northerly of North Road, the easterly and westerly lines of the above premises being parallel
to each other and also parallel to the easterly line formerly of William Amott; the above described
parcel consisting of Lots 21 and 22 as shown on an unfiled map of Sound Shore Property of Young and
Talmage made by Otto W. Van Tuyl, L.S. of Greenport, New York, on April 11, 1925, amended July
14, 1944. ,
TOGETHER with all the right, title and interest, in any, of the parties of the first part in and to North
Road and Long Island Sound lying in front of and adjacent to the above described premises.
AND the party of the second part for herself, her distributees or assigns does hereby covenant and agree
to and with the parties of the first part, their distributees and assigns, that neither the party of the second
part nor her distributees or assigns shall or will erect more than one dwelling on any portion of the
above described premises having less than 100 foot frontage on Long Island Sound or a similar frontage
on North Road, said covenant to run with the land.
BEING and intended to be the same premises conveyed to John A. Schlecht, by deed dated the 12th day
of May 2000, made by John A. Schlecht and Marie Schlecht, his wife, recorded in the Suffolk County
Clerk's office on May 19, 2000, in Liber 12043 at page 482.
TOGETHER with an undivided 81.25% right, title and interest, if any, of the party of the first
part in and to any streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances, and also an undivided 81.25% interest in the estate which
the said decedent had at the time of decedent's death in said premises, and also the estate therein, which
the party of the first part has or has power to convey or dispose of, whether individually, or by virtue of
said will or otherwise,
TO HA VEAND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the costs of the
improvement and will apply the same first to the payment of the cost of the improvement before using
any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

year first above written.
