THIS INDENTURE, made the September 11,2001,
between Andrew Grillos and Leni G. Grillos, husband and wife, of 2320 Burnett Street, Brooklyn, New York

party of the second part,
WITNESSETH, that the party of the first part, in consideration of 10,00 dollars, lawful money of the
United States, paid by the party of the second part, does heroby grant and release unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Arshamomaque, in the Town of Southold, County of Suffolk and State of New York,
bounded and described as follows:
BEGINNING at a monument on the northerly side of Middle Road at the southeast corner of land now
or formerly ofJ, Xikis;
RUNNING THENCE north 13 degrees 56 minutes 40 seconds west along said last mentioned land and
passing through an'iron pipe, 92.80 feet to the ordinary high water mark of Long Island Sound;
THENCE along the ordinary high water mark of Long Island Sound, a distance of 56.17 feet on a tie line
course of noah 72 degrees 29 minutes 30 seconds east to land conveyed by Kenneth Cummings and Jane
Cummings, his wife, to Robert E, Dietrich and Virginia L. Dietrich, his wife, by deed dated March 7, 1976 and
recorded in the Office of the County Clerk of Suffolk on March 24, 1976 in Liber 8007 of conveyance at page 73;
THENCE south 14 degrees 30 minutes 00 seconds east along said last mentioned land, and passing
through an iron pipe, 96.30 feet to an iron pipe on the northerly side of Middle Road;
THENCE south 76 degrees 03 minutes 20 seconds west along the northerly side of Middle Road, 57.00
feet to the monument at the point or place of BEGINNING.
TOGETHER with all of the right, title and interest of the party of the first part of, in and.to the waters and
the land under the waters of Long Island Sound in front of and adjacent to said premises and Middle or North
Road adjacent to the premises to the center line thereof. ~
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof,

TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,
TO HA VE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of the total of the same
for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first pa.rt has duly executed this deed the day and year first
