part, the heirs or successors and assigns of the party of the
second part forever,

19,1988, from Jean H. Tuthill, the County Treasurer of Suffolk
County, New York and recorded on February, 19,1988, in Liter
10544, CP 113, and otherwise known as and by Town of Southold,

formally Passadakes & ors., W x Tucker La.,
ALL, t~t certain plot, piece or parcel of land with any
buildings and improvements thereon erected, situate, lying and
being in the Town of Southold, County of Suffolk and State of
New York, described on the Tax Map of the Suffolk County Real
Property Tax Service Agency as District 1000, Section 074.00,
Block 01.00, Lot 044.011, and acquired by Tax Deed on April
19,1988, from Jean H. Tuthi11, the County Treasurer of Suffolk
County, New York and recorded on April 19,1988, in Liter 10585,
CP 63, and otherwise known as and by Town of Southold, "Peconic
Knolls' Map No. 6607, filed in the Office of the Clerk of
Suffolk County on September 29,1977 as lot 44.11, designated as
the Park,

buildings and improvements thereon erected, situate, lying and
being in the Town of Southold, County of Suffolk and State of
New York, described on ~he Tax Map of the Suffolk County Real
.Property Tax Service Agency as District 1000, Section 079.00,
Block 03.00, Lot 030.000, and acquired by Tax Deed on March
5,19~1, from General L. Rains, the Deputy County Treasurer of
Suffolk County, New York and recorded on March 11,1991, in
Liter 11230, CP 177, and otherwise known as and by Town of
Southold, Bayview Woods Bstates, Map No. 5520, Lot 30, Park &
Playground Area, filed in the Office of the Clerk of Suffolk
County,
PRO%-XD~D, however, that the Town of Southold will be
restricted in its use of the subject premises and will use said
premises solely and exclusively for municipal purl~oses; with all
right title and interest reverting to the party of the first part
in the event that the Town of Southold, at any time, uses or
attempts to use said subject premises for other than municipal
purposes or attempts to sell, transfer or otherwise dispose of
said subject premises without said premises being used thereafter
for municipal pUrlOoses. This covenant and restriction will run
with the land and shall bind the heirs or successors and assigns
of the party of the second part,

party of the first part of, in and to any streets and roads
abutting the above-described premises'to the center lines
thereof;

rights of the party of the first part in and to said premises;

party of the second part, the heirs or successors and assigns
of the party of the second part forever.

eU~CT to the condition that neither Grantee nor any
Municipality shall bill or charge back to Grantor any cost
incurred or projected to be incurred for the cleaning up of any
debris on said property. In the event that such charge hack or
bill is rendered to the Grantor this Deed shall be void ab initio
and the rea%ty shall revert to the Grantor.
AND the party of the first party, in compliance with Section
13 of the Lien Law, hereby covenants that the party of the
first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of
the total of the same for any other purpose.

whenever the sense of this indenture so requires.
