WITNESSETH, that the party of the first part, to whom letters testamentary were issued by the
Surrogate's Court, Suffolk County, New York on November 12, 2004, and by virtue of the power and
authority given in nnd by said last will and testament ap.d/or by Article I i of the Estates, Powers nnd
Trusts Law, and in consideration of S247,917.00, paid by the pray of the second part, does hereby gnmt
and release unto the pa~y of the second part, the distributees or successors and assigns of the party of
the second paFt forever,
ALL that certain plot, piece or parcel of land with thc buildings and improvements thereon erected,
situate, lying and being in the Town of Southold, County of Suffolk and State of New York, bounded
nnd described as follows:
BEGINNING at n concrete monumenl on the northerly side of North Road, also sometimes known as
"Old Kings Highway", which monument is at the soutbeasterly comer of land now or formerly of
Charles Buff, and the southwesterly comer of the premises herein described; Imm said point of
I~ginning;
RUNNING THENCE along said land now or formerly of Charles Burl, North 13 de~rces 18 minutes 30
seconds West a distance of 441 feet, more or less, to the ordinary high water mark of Long Island
THENCE along said ordinary high water mark of Long Island Sound in a southeasterly direction
measured on a tie line bearing South 74 degrees 06 minutes 40 seconds East a distance ol'85.91 feet. to
land now or formerly of Ruekel'eller;,
THENCE along land now or formerly of Roukefe]ler, South 13 degrees 18 minutes 30 seconds East a
distance of 400 feet, more or less, to the northerly side of North Road;
THENCE along said northerly side of North Road, South 77 degrees 23 minutes West a distance of 75

BEING AND INTENDED TO BE thc same premises convcycd to the party of the lust part by dccd
from Rosina B. Cunningham, dated 1/14/04 end recorded 3/3/04, in the O~cc of the Suffolk County
Clerk in Liber 12304, Page 829.
TOGETHER with all fight, title nmi inte~st, if eny, of the pat~y of the first part in and to any slreets and
roads abutting the above described premisea to thc center line thereof,
TOGETIIER with the appurtenances, and also the ~tat~ which th~ said decedant had at the time of
decedent's death in said premises, and also the esme therein, which the party of the first part has or has
the power to convey or dispose of, whether individually, or by virtue of said will or otherwise,
TO HAVE AND TO HOLD thc premises herein granted unto the party of the second pan, the
disttibutees or successors and mi~m of the party of thc second part forever.
AND the party of the first part covenants that the party oftha first part has not done or suffered anything
whereby tho said premises have bcen incumbered in any way whatever, except ns aforesaid.
AND the party of the first part, in compliance with Section 13 ofthe Lien Law, covenants that the party
of the first pa~ will receive the consideration for this conveyance and will bold the right to receive such
consideration ns a trusl fired to be applied first for the purpose of paying the cost of improvement and
will apply same first to the payment of the cost of imprevement before using any part of the total of the
same .for any other purpose.
