THIS INDENTURE, made the 22nd day of July, Two Thousand Two
BETWEEN
KATHERINE K. POERSCHKE, surviving tenant by the entirety of Herman A. Poerschke, who
died a resident of Suffolk County on 12/06/69, ~iding at.~5055 County'Road 48, Greenport,

party of the first part, and
NSHE DOBB1NS, LLC, an Arizona limited liability company, By: National Safe Harbor
Exchanges, a California corporation, whose address is 2390 Camelback Road, Phoenix, Arizona
85016,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second pa?t, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New
York, bounded and described as follows:
BEGINNING at a concrete monument set at a point on the northerly side of the North Road,
which monument designates the intersection of the southeast corner of the property herein
described and the southwest comer of land now or formerly of Cunningham;
RUNNING THENCE North 78 degrees 55 minutes 40 seconds West along the northerly side
of the North Road a distance of 64.03 feet to land formerly of Avdoulos;
THENCE RUNNING North 12 degrees 54 minutes 14 seconds West along the said last
mentioned land 428.67 feet to highwater mark of Long Island Sound;
THENCE RUNNING along a tie line which marks the approximate high water mark of Long
Island Sound on 5/31/2002, South 74 degrees 57 minutes 27 seconds East 80.60 feet to lands
now or formerly of Cunningham;
THENCE South 11 degrees 46 minutes East 415 feet along said land formerly of Cunningham
to the northerly side of the North Road, and a concrete monument at the point of place of
BEGINNING.

TOGETHER with all right, title and interest, if any, of the Seller of, in and to the lands lying
under the waters of Long Island Sound.
BEING AND INTENDED TO BE the same premises conveyed to Herman A. Poerschke and
Katherine K. Poerschke by deed made by Burt's Coal, Inc., dated April 10, 1964, and
recorded April 15, 1964, in the Office of the Suffolk County Clerk in Liber 5528, Page 464.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premi~s}s herein ~granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of~the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.
