D'ANTONIO, late of Southold,New York, who died intestate on November 9, 1994,party of the first part, and, THOMAS S. D'ANTONIO, residing at 152 Trevor Court Road, Rochester,New York, party of the second part: Witnesseth, that whereas letters of administration were issued to the party of the first part by the Surrogate's Court, County of Suffolk,New York on March 25, 1996 and by virtue of the power and authority given in and by Article 1 I of the Estates, Powers and Trusts Law, or any amendment thereof from time to time made, and in consideration of One and no/100 Dollar ($1.00) lawful money of the United States, paid by the party of the second part, the receipt whereof is hereby acknowledged, does hereby grant and release unto the party of the second part, his successor and assigns forever, ALL THAT CERTAIN PLOT, PIECE OR PARCEL OF LAND, with the buildings and improvements thereon erected, situate, lying and being at Southold, in the Town of Southold, County of Suffolk and State of New York, bounded and described as follows: Parcel One: Beginning at the intersection of the westerly line of Kenney's Road with the northerly line of Soundview Avenue; running thence along said northerly line of Soundview Avenue two courses, as follows: 1.) South 27 degrees 07 minutes 40 seconds West a distance of 2.44 feet to a concrete monument; thence 2.) along a curve to the left having a radius of 625.69 feet, a distance of 163.08 feet to land now or formerly of Hahn; thence along said land now or formerly of Hahn, North 42 degrees 37 minutes 00 seconds West a distance of 152.69 feet; thence along other land now or formerly of George W. Smith& Sons, Inc.,North 47 degrees 49 minutes 40 seconds East a distance of 146.81 feet to said westerly line of Kenney's Road; thence along said westerly line of Kenney's Road South 42 degrees 10 minutes 20 seconds East a distance of 75.0 feet to the point of beginning. Parcel Two: ALL THAT CERTAIN PLOT, PIECE OR PARCEL OF LAND, with the buildings and improvements thereon erected, situate, lying and being at Southold, in the Town of Southold, County of Suffolk and State of New York, bounded and described as follows: Beginning at a point on the easterly line of land now or formerly of Arthur W. Hahn, Jr. (which point is North 42 degrees 37 minutes 00 seconds West a distance of 152.69 feet from the northerly line of Sound View Avenue; and which point is the northwesterly comer of Parcel One above described and the southwesterly comer of the premises herein described); running thence North 42 degrees 37 minutes 00 seconds West a distance of 100 feet, more or less, to the shore of Great Pond; running thence in an easterly direction along the shore of Great Pond a distance of 10 feet or more to a point which is distant 10 feet from the direct extension northerly of the westerly line of the premises herein described when measured at right angles thereto; running 8231965.1 - 2 - thence in a southeasterly direction South 42 degrees 37 minutes 00 seconds East on a line parallel to and at all points 10 feet easterly from the aforesaid westerly line when measured at right angles thereto, a distance of 100 feet or more to the northerly line of Parcel One above described; running thence South 47 degrees 49 minutes 40 seconds West a distance of 10 feet to the point or place of beginning. Said premises being a strip of land 10 feet in width and extending from the northwesterly corner of Parcel One above described northerly to Great Pond. Being and hereby intending to convey the same premises conveyed to Arva D'Antonio, by Deed dated May 30, 1985, and recorded in the Suffolk County Clerk's Office on June 13, 1985, in Liber 9809 of Deeds, at page 261. Subject to any and all covenants, easements and restrictions of record affecting the above described premises. Tax Map No.: 059.00-06-024 Tax Mailing Address: 152 Trevor Court Road, Rochester,New York 14610 TOGETHER with the appurtenances, and also all the estate which the said Decedent had at the time of her decease, in said premises. And also the estate therein, which the party of the first part has or had power to convey or dispose of, whether individually, or by virtue of said Estate or statue or otherwise. To Have and to Hold the premises herein granted unto the party of the second part, his successors and assigns forever. And the party of the first part covenants that he has not done or suffered anything whereby the said premises have been encumbered in any way whatever. That, in compliance with Sec. 13 of the Lien Law, the party of the first will receive consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
