WITNESSETH, that the party of the first part, in consideration often Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying
and being in the
Town of Southold, County of Suffolk and State of New York, known and designated as Lot No. 5 as
shown on a certain map entitled, "Map of Willow Point" and filed in the Suffolk County Clerk's Office on June 16,
1966 as Map No. 4652, and being more particularly bounded and described as follows:
BEGINNING at a point on the northerly side of Budd's Pond Road where same is intersected by the division line
between lot Nos. 4 & 5 as shown on said map;
RUNNING THENCE North 33 degrees 45' 00" West, along said division line, 143.44 feet to the southerly side of
Main State Road;
THENCE North 58 degrees 23' 00" East, along said Main State Road, 130.00 feet to lot No. 6 on said map;
THENCE South 21 degrees 59' 40" East, 148.92 feet to the northerly side of Budd's Pond Road;
THENCE, along the northerly side of Budd's Pond Road, the following two (2) courses and distances;
1) South 61 degrees 45' 00" West, 50.00 feet;
2) Westerly along an arc of a curve bearing to the left, having a radius of 519.26 feet a distance of
49.85 feet to the point or place of BEGINNING.
TOGETHER with the right in common with others owning lots in this subdivision to the use of a marina and beach area
as shown on said Subdivision map.
with all right, title and interest, if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been incumbered in any way whatever, except as aforesaid·
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
fu'st part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
fa'st to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
