WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by paid last
will and testament, and In consideration of Ten Thousand ($10 ,000 .00) and 00/100

paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, with the buildings and Improvements thereon erected,situate,
lvinq and being at Mattituck, in the Town of Southold,County of Suffolk, State of New York,bounded and '
described as follows:
BEGINNING at a concrete monument set on the southerly line of a certain 24 foot right-of-way known
as Fox Hollow Road where the same is intersected by the westerly line of other premises of William R
Wertenberg,which said point of beginning is the following courses and distances from the point of intersection
of the easterly line of Cox Neck Road (a public highway) and the southerly line of a private road known as
Miller's Right-of-Way: (1) South 85 degrees 30' East, a distance of 1121.61 feet, more or less,to a concrete
monument; (2) South 18 degrees 07 30"East, a distance of 594.33 feet; (3) South 71 degrees 52' 30" West,
a distance of 137.50 feet to the concrete monument at the point of beginning of the within described parcel;
from said point of beginning thence running South 71 degrees 52'30" West along the southerly line of said 24
foot right-of-way known as the Fox Hollow Road, a distance of 147.78 feet to a point; thence running South
12 degrees 07 East, a distance of 244.52 feet to a point; running thence North 71 degrees 52' 30" East, a
distance of 60.87 feet to a concrete monument;running thence South 18 degrees 07 30"Fast,a distance of 84
feet, more or less, to the shores of Mattituck Creek; running thence in a general easterly direction along the
shores of Mattituck Creek to a point which bears South 18 degrees 07 30"East,from the concrete monument
at the place of beginning; naming thence North 18 degrees 07 30" West along other lands of William H.
Wertenberg and through a concrete monument, a distance of 338.18 feet, more or less, to the concrete
monument set at the point or place of beginning.
ALSO all that other piece or parcel of land lying immediately to the north of the parcel above
described and comprising the land lying in the bed of the said 24 foot right-of-way known as Fox Hollow Road,
bounded and described as follows:
BEGINNING at the same monument marking the point of beginning of the parcel above described and
running thence North 18 degrees 07 30" West,a distance of 12 feet to the center of said 24 foot right-of-way
known as Fox Hollow Road; running thence South 71 degrees 57 3d" West along the center of s"24 foot
right-of-way known as Fox Hollow Road,a distance of 157 feet, more or less, to the end of said Fox`Hollow
Road and the westerly boundary line of property of William H. Wertenberg;naming thence South 12 degrees
07 East,a distance of 12 feel,more or less,to a concrete monument;running thence North 71 degrees 52'30"
East along the southerly line of said 24 foot right-of-way known as Fox Hollow Road,,a distance of)57.84 feet

TOGETHER with all right, title and Interest, If any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances,
and also all the estate which the said decedent had at the time of decedent's death in said premises, and also
the estate therein, which the party of the first part has or has power to convey or dispose of,whether individ-
ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever.

AND the party of the first part, in compliance with Sccticn 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance Ind will hold the right to receh a such consid-
eration as a trust fund to be applied first for the purpose of P-10119 the cost of the improvement and will apply
the some First to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.

SUBJECT, however, to the reservation by William H. Wertenberg, his heirs, administrators,
executors, successors, assigns and grantees of a right-of-way for ingress and egress over such
portion of said 24 foot right-of-way known as Fox Hollow Road above described and
conveyed, and
ALSO SUBJECT to all existing rights-of-way heretofore conveyed by William H.
Wertenberg over said portion of said 24 foot right-of-way.
ALSO all that other piece or parcel of land lying immediately to the West and South
of the parcel fust above described and comprising the land lying in the bed of a certain
right-of-way to and from the shores of Mattituck Creek bounded and described as follows:
BEGINNING at a point on the southerly line of said 24 foot right-of-way known as
Fox Hollow Road where the same is intersected by the westerly line of the parcel fust above
described; running thence South 12 degrees 07 East, a distance of 244.52 feet to a point;
awning thence North 71 degrees 52' 30" East, a distance of 60.87 feet to a concrete
monument; running thence South 18 degrees 07 30" East, a distance of 84 feet, more or less,
to the shores of Mattituck Creek; running thence in a general westerly direction along the
shores of Mattituck Creek, a distance of 75 feet, more or less, to a point and lands formerly
of Young, nursing thence North 12 degrees 07 West along said lands formerly of Young,
a distance of 305 feet, more or less, to a concrete monument set on the southerly line of said
24 foot right-of-way known as Fox Hollow Road; running thence North 71 degrees 52' 30"
East along the southerly line of said Fox Hollow Road, a distance of 10.06 feet to the point
or place of beginning.
SUBJECT, however, to all existing rights-of-way over said parcel for ingress and
egress to and from the shores of Mattituck Creek, and
ALSO SUBJECT to the reservation by William H. Wertenberg, his hens,
administrators, executors, successors, assigns and grantees of a right-of-way for ingress and
egress to and from the shore of Mattituck Creek over said parcel as above described and
conveyed.
TOGETHER with all right of way for ingress and egress in common with all others
now having or hereafter acquiring similar rights of way over the following:
1. A certain private road known as Miller's Right-of-Way being 24 feet in width
running in a general easterly direction from the easterly side of Cox Neck Road (a public
highway) to a point 1466.05 feet, more or less, from said easterly side of Cox Neck Road.
2. A certain 24 foot private right-of-way known as Raccoon Road, running from
a point on the southerly line of said Miller's Right-of-Way South 18 degrees 07 30" East a
distance of 570.33 feet.
3. Another 24 foot right-of-way known as Deerpath Road, running from a point
on the southerly line of said Millet's Right-of-Way South 22 degrees 30' East a distance of
449.50 feet.
4. Another 24 foot right-of-way known as Fox Hollow Road, running South 71
'degrees 52' 30" West a distance of 720.37 feet in a general East-West direction completely
across the property now or_formerly of William H. Wertenberg.
