THIS INDENTURE, made the
BETWEEN
day of March, in the year Two Thousand Three
BENJAMIN CALDERONE and PATRICIA CALDERONE, husband and wife, both residing at
280 Pond Avenue, Southold, New York 11971
paity of the first part, and
CATHLEEN KORMOSKI, residing at 110 Terrace Road, Bayport. New York 11705; and
BENJAMIN H. CALDERONE, residing at 4 Bates Lane, Ridge, New York 11961
party of the second part,
WITNESSETH. that the party of thc first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the sccond pan, does hereby grant and release unto the parly
of the second part, the heirs or successors and assigns of the party of the second part forever.
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being at Southold, in the Town of Southold, County of Suffolk and State of
New York, known and designated as Lot 36 on a certain map entitled "Map of Long Pond
Estates, Section Two" and filed in the Office of the Clerk of the County of Suffolk on
11/29/90 as Map No. 9031, which said lot is more particularly bounded and described as
follows:-
BEGINNING at a point on the southerly side of Pond Avenue. distant 245.78 feet east, as
measured along the southerly side of Pond Avenue from the extreme easterly point of the arc
of a curve that connects the southerly side of Pond Avenue and thc easterly side of Laurel
Avenue, said arc of a curve has a radius of 25.00 feet and a length of 38.86 feet, said point of
beginn!ng also be!ag 9t .the. division, l!ne between Lot 36 and Lot 31 as shown on said aforesaid
map;
RUNNING THENCE along the southerly side of Pond Avenue, North 75 degrees 38 minutes
50 gconds East, 150.04 tbet actual (150.02 feet map) to the division line between Lot 36 and
37;
RUNNING THENCE along said division line, south 13 degrees 04 minutes 00 seconds East,
269.37 feet actual (268.46 feet map.};
RUNNING THENCE South 76 degrees 56 minutes 00 seconds West, 150.00 feet;
RUNNING THENCE North 13 degrees 04 minutes 00 seconds West, 266.00 feet to the
southerly side of Pond Avenue and the point or place of BEGINNING.
BEING AND INTENDED TO BE ~ same premises conveyed to the party of the first part by
deed from Steven K. Sprengel and Patti.cia Sp. rcng¢l, his wife, dated September 29, 1994, and
recorded in the Suffolk County Clerk's Office on October 13, 1994, in Liber 11698 page 237.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the
buildings and improvemems thereon erected, in and to the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as they may choose, tn change their remainderman as
follows:
TO or among any one. or more members of a class consisting of the party of the first part's
descendants, in any degree, whether presently living or born hereafter, in such proportions and
amounts, without regard to equality, outright or in trust, as the party of the first part may
direct and appoint during their lifetime by a properly written and acknowledged instrument,
and recorded prior to death, making specific reference to this power of appoinunent. The
party of the first part may not appoint ~emselves, their estates, their creditors or the creditors
of their estate, under any circumstances.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting thc above described premises to the center lines thereof; TOGETHER
with the appurtenances and all thc estate and rights of thc party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of thc patty of the second part forever.
AND the party o£ the first part covenants that thc party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party o£ the first pan, in compliance with Section 13 of the Lien Law, covenants that
the party of the firs! parl will receive the consideration for this conveyance and will hold the
right to receive such consideration as a Irust £und to be applied first for the purpose of paying the
cost of the improvemcnt and will apply thc same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense ofthis indenture so
requires.
