THIS INDENTURE, made the 30th day of September, 2008
BETVVEEN
JOHN G. CAULFIELD and MICHELLE E. LEIGHTON, as joint tenants with rights of survivorship, having an
address of 333 Earle Ovington Blvd., Suite 900, Uniondale, New York 11553,
party of the first part, and
ALLAN ROSENBLOOM and KELLY ROSENBLOOM, as husband and wife, having an address of 333 East
45th Street, #27B, New York, NY 10017,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Southold, in the Town of Southold, County of Suffolk and State of New York, known and
designated as Lot 11 as shown on a certain map entitled, "Subdivision Map of Long Pond Estates, Section
One, situate at Southold, Town of Southold, County of Suffolk, State of New York," and filed in the Office of the
County Clerk of the County of Suffolk on 12/27/1985 as Map # 8037. Said premises are also described as
follows:
BEGINNING at a point on the southerly side of Long Creek Drive, where the same is intersected by the
division line between Lot 11 and Lot 12 on said map. Said point is also described as 111.42 feet westerly as
measured along the southerly side of Long Creek Drive from the northwesterly end of a curve connecting said
southerly side of Long Creek Drive with the westerly side of Park Avenue;
THENCE along said division line, on a course South 09 degrees 45 minutes 00 seconds East, a distance of
277.18 feet to the northwesterly corner of Lot 13 on said map and the southeasterly corner of the herein
described premises;
THENCE along the division line between Lot 11 and the premises designated as "open space" on a certain
map entitled "Subdivision Map of Long Pond Estates, Section Two," filed in the Office of the Suffolk County
Clerk on November 29, 1990 as File No. 9031, on a course South 70 degrees 38 minutes 50 seconds West, a
distance of 161.00 feet to a concrete monument set in the easterly side of Long Creek Dive;
THENCE along the easterly and southerly side of Long Creek Drive, the following courses and distances: a)
North 08 degrees 21 minutes 10 seconds West, a distance of 228.93 feet to a point of curve, b) Thence
northeasterly on a curve to the right, having a radius of 60.00 feet, a distance of 82.73 feet to a point on the
southerly side of Long Creek Dive, c) Thence along the southerly side of Long Creek Drive, North 70 degrees
38 minutes 50 seconds East, 104.67 feet to the point and place of BEGINNING.
Being and intended to be the same premises as that transferred to the party of the first part by deed dated
December 19, 2005 and recorded in the Office of the Clerk of the County of Suffolk on January 11, 2006 in
Liber 12430 page 85.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
)remises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as if it read "parties" when ever the sense of this indentu/e~o requires.
