Moorhead and which was placed to mark the boundary between lands of Jean Moorhead and the LK: 11 premises by an agreement dated October 25th, 1928, recorded October 31st, 1928 in the Office of the Clerk of Suffolk County; OT: 016 RUNNING THENCE South 26 degrees, 8 minutes 00 seconds East along said land of Moorhead, 330 feet more or less to the high water line of Peconic Bay. The said course passing through a concrete monument distant Northerly 43.5 feet from the said high water mark; THENCE North 43 degrees, 32 minutes 00 seconds East along the high water mark of Peconic Bay as the same winds and turns 100.92 feet to the Southwesterly corner of land of Dr. Justus Wright; THENCE North 27 degrees, 12 minutes 00 seconds West along said land of Dr. Wright, 332.40 feet to a concrete monument on the Southeasterly side of Peconic Bay Boulevard aforesaid, the said course passing through a concrete monument at a distance of 60.4 feet North of the high water line of the Bay; THENCE South 40 degrees, 57 minutes 00 seconds West along the Southeasterly side of Peconic Bay Boulevard, 96 feet to the point or place of BEGINNING. The Grantors herein being the same persons as the named Grantees in a certain deed dated 12/29/93 recorded 2/10/94 in Liber 11664 cp 246. TOGETHER with all right, title and interest, if any,of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and all, the estate and rights of the party of the first part in and to said premises, TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
