FIECHTER, being married to each other, residing at 19 Seacove Court Jamesport, NY 11947 party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a concrete monument set on the southerly line of Mill Road at the northeasterly corner of land now or formerly of Joseph Leo Grande; "sS// RUNNING THENCE along a said southerly line of Mill Road North 73 degrees 52 minutes 30 seconds East 244..94 feet to a concrete monument and land now or formerly of Mattituck Holding Co. Inc.; THENCE along said lands, South 1 degrees 57 minutes 20 seconds East, 139.19 feet to a monument and land now or formerly of Joseph Leo Grande; THENCE along said lands the following two courses and distances: 1) North 84 degrees 53 minutes 40 seconds West 198.46 feet to a monument; 2) North 45 degrees 51 minutes 50 seconds West, 72.64 feet to the point or place of BEGINNING. Said last mentioned two courses and distances being the center line of the right of way 20 feet wide hereinafter referred to, Together also with a right of way over and upon said land now or formerly of Alonzo F. Robinson, along the two courses and distances last above mentioned, being ten feet in width measured at right angles to each of said two courses. Sec. 106.00 Block 06.00 Lot 007.000 TOGETHER with all right, title and interest, it any, of the party of the first part in and to any streets and road abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises, r TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
