IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed, and these presents to be subscribed by a majority of the said Board as of this date. TERMS AND CONDITIONS The Permittee Daniel N. Kohn Living Trust, residing at 500 Little Peconic Bay Road, Cutchogue, New York as part of the cOnsideration for the issuance of the Permit does understand and prescribe to the following: That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. That this permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. That there will be no unreasonable interference with navigation as a result of the work herein authorized. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall canse unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. That the said Board will be notified by the Permittee of the completion of the work authorized. KOHN LIVING TRUST applied to the Southotd Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated Apdl 21, 2008, 2008, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 18, 2008, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of DANIEL N. The +119' section of bulkhead will be replaced in-place with a +117' section of bulkhead ending at the easterly property boundary, and rather than being replaced in-place, the easterly +14' bulkhead return will be resheathed with vinyl (raised 12") on its landward side; 2. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is consistent with the LWRP; Provided that the proposed action meets LVqRP sub-policy 6.3 (A), § 268-3 & 5 and § 275-2 & 11 as outlined below. The proposed action is sub|ect to the Town of Southold's Waterfront Consistency Law Chapter § 268-5 (A) Review of actions and will require the applicant to complete and file an LWRP Consistency Review form before a final determination can be rendered. § 268-5. Review of actions A. Whenever a proposed action is located within the Town's coastal area, each agency shall, prior to approving, funding or undertaking the action, make a determination that it is consistent with the LWRP policy standards summarized in 3q 268-1 herein. No action in the coastal area shall be approved, funded or undertaken by an agency without such a determination. The proposed action has been reviewed pursuant to § 268-3 and is not an in-kind replacement but is (up to 12" higher than) the existing bulkhead~ with a new 16' vinyl return. § 268-3. Definitions MINOR ACTIONS -- Include the following actions, which are not subject to review under this chapter: A. Maintenance or repair involving no substantial changes in an existing structure or facility; B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site, including upgrading buildings to meet building or fire codes, except for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed without a permit; The proposed action will require the installation of a silt boom that will retain all suspended sediments within the immediate proiect area pursuant to § 275-11 Construction and operation standards. § 275-11 Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area. The following standard is required pursuant to § 275-11 and § 275-2; Install a non-turf pervious buffer to replace the existing 6' X 55' timber decking following its removal. § 275-2 Definitions; word usage. NONTURF BUFFER -- Any pervious material allowing for percolation of surface runoff into the soil. Examples include: natural vegetation, wood chips, mulch, gravel, and sand. Decks may be allowed if they are level or pitched away from the water, are pervious to precipitation and are constructed of materials other than treated lumber. Any and all runoff generuted by such structures must be allowed to percolate into the ground directly below the structure. Fertilizers may not be used wit/lin the nonturf buffer area. § 275-11 Construction and operation standards. .B. Shoreline structures. The following standards are required for all operations relating to shoreline structures on residential properties. Operations conducted on properties zoned MI or M2 may be given greater flexibility in these requirements given the water- dependent nature of their use. [Amended 10-11-2005 by L.L. I have concerns with the approval of this application that I have enumerated below. Also enclosed is an existing site plan of the property for which the wetlands permJ, t is being requested This is a substantial renovation that if approved, would perpetuate existing conditions that are not consistent with the current Wetland Ordinances of the Town of Southold. There appears to be little attempt to adhere to current codes. The existing bulkhead is located entirely beyond the property fie line and infringes on Wurmeweta Pond at a narrow section of the pond. In addition, part of the existing bulkhead was constructed on deeded underwater lend that I own and have title to. Any approval of the application should require that the bulkhead be reconstructed without infringement on my property, The existing shed, requested to be maintained, is a pump house according to the site plan. The need for this structure now that SCWA has provided service is questionable at best. The shed is currently less than six feet from the water, and would not be an allowable use or meet setback requirements under currant code. The current application calls for this structure to remain in place and to be raised 27". If approved and constructed, this work would place the grade at thc shared property line at a higher elevation than my adjacent property. Proper means of controlling surface runoff and a method to keep the runoff on the applicant's property should be included in thc application. The application calls for a 6' X 55' section of timber decking to bc replaced and reoriented to place this structure directly on the property line with no set back. ]u addition to adding structuro within 75 feet of thc water that decremses surface water absorption and increases nmoffinto the pond, the location will create an access concern. Workmen maintaining the walkway will need to access my property and an elevated timber walkway will require additional yard maintenance and edg/ng. If this walkway is deemed an acceptable use, I would like to see it relocated and setback from thc property line a reasonable distance.
