P.O. Box 1'6.75, Southold, New York 11971, party of the second part,
WITNE$$ETH, that the pady of the first part. in consideration of Ten and 00/100-($10.00)-Dollars, and
other good and valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land. situate, lying and being in the Town of Southold, County of
Suffolk and State of New York. bounded and described as follows:
BEGINNING at a point on the northerly side of Main Road (NYS Route 25) distant 259.94 feet wsetedy as
measured along the northerly side of Main Road from the corner formed by the intersection of the
northerly side of Main Road and the westerly side of Moore's lane;
RUNNING THENCE South 75 degrees 14 minutes 40 seconds West along the northerly side of Main
Road, 254.65 feet to lands new or formerly of Zipkas;
RUNNING THENCE North 06 degrees 57 minutes 20 seconds West along lands last mentioned, 274.85
feet to lands now or formerly of the Village of Gmenport;
RUNNING THENCE North 89 degrees 57 minutes 00 seconds East along lands last mentioned. 265.40
feet to lands new or formerly of New York Telephone Company:
RUNNING THENCE along lands last mentioned, the following two (2) courses and distances:
1. South 00 degrees 18 minutes 40 seconds East. 159.44 feet;
2. South 15 degrees 13 minutes 20 seconds East. 50.54 feet to the northerly side of Main Road at the
point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the f'gst part by deed dated
May 26, 2005, recorded June 10, 2005 in Liber 12391 page 703 in the Suffolk County Clerk's africa.
TOGETHER with all fight, tiUe and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and dghts of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted u~to the party of the second part. the heirs or
8ucoes~ors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premlaBE have been encumhered in any way whatever, except aa aforesaid.
AND the party of the r~at part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first pad will receive the consideration for this conveyance and will hdid the right to receive such
consideration aa a trust fund to be applied first for the purpose of paying the cost of the improvement and
mil apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word 'party* shall be construed as if it read 'parties' whenever the
sense of this indenture so requires.
