WITNESSETH, that the party of the first part. in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby granl and release unto the patly
of the second part, the he/rs or successors and assigns of the party of the second part forever
ALL that certain plot, piece or parcel of land, with the buildings and inaprovements thereon
erected, situate, lying and being at Arshamomaque, Town of Southold. County of Suffolk and
State of New York. bounded and described as follows:
BEGINNING at a point on the northeasterly line of Bayview Avenue. 638.91 feet
northwesterly along said northeasterly line from Colony Road; from said point of beginning
RUNNING along said northeasterly line of Bayviexv Avenue North 46 degrees 41 minutes 30
seconds West 100 feet to the land of Rueh;
THENCE along said land of Ruch, two courses, as follows:
(1) North 62 degrees 45 minutes East 10.75 feet;
(2) North 68 degrees 45 minutes East 154.88 t~et to Land now or formerly of J. Herbert
Cassidy;
THENCE along land of J. Herbert Cassidy two courses, as folloxvs:
(1) South 46 degrees 41 minutes 30 seconds East 80 feet;
(2) South 61 degrees 46 minutes 50 seconds West 158.15 feet to the northerly side of Bayview
Avenue, to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from Sophie Mutkos 'ki. dated September 3. 1971. and recorded September 13, 1971, in
the Office of the Suffolk County Clerk in Liber 7004, Page 450.
~TOGETHER with all right, title and interest, if any, of the party of the first part in and to aa7
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of fl~e second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliqnce with Section 13 of the Lien Laxv, covenants that
the party oF thc first part will receive thc consideration for this conveyance and will hold tho
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the paHnent of the cost of the
improvement before using any part of the total oftha same for any other purpose.
The word "party" shall be cons/mod as if it read "parties" whenever the sense of this indenlure so
requires.
