EASEMENT AGREEMENT

between Ms. Rose V. Mc Cann, owner of 322 North Road, Grcenport, NY 11944, ("Grantor"),
and LONG ISLAND LIGHTING COMPANY d/b/a LIPA ("LIPA"), a New York Corporation,
having its principal office at 333 Earle Ovington Boulevard, Suite 403, Uniondale, New York
11553 (hereinafter referred to as the "Grantee"). (Grantor and Grantee are collectively referred to
herein as the "Parties".)
WlTNESSETH, that the Grantor, in consideration of the payment of one dollar ($1.00)
and other good and valuable consideration paid by the Grantee, does hereby grant and release
unto the Grantee, their successors and assigns, forever, an easement and right-of-way on, over,
under, across, through and along two (2) distinct portions of the land of the Grantor lying and
being in Greenport, Town of Southold, County of Suffolk, State of New York, located in
SECTION 45, BLOCK 1, LOT 5 and shown on a map of said land entitled "Boundary Survey"
(the "Property"). A copy of said map and/or legal written description on which are now shown
me location and width of the said easement and right-of-way herein granted (the "Easement
Area"), is attached hereto and made a part hereof as "Exhibit A".
Said easement and right-of-my herein granted include the following rights and
privileges:
FIRST: The permanent and perpetual easement, right, privilege and authority to construct,
reconstruct, relocate, operate, repair, maintain and, at their pleasure, remove the guy wire and
associated underground anchor as said Grantee may now and from time to time deem necessary,
all within the Easement Area.
SECOND: The privilege of such access from the street over the balance of the Grantor's
property as is necessary for the enjoyment of the easement and right-of-way herein granted.
THIRD: The Grantor agrees not to erect or maintain within the Easement Area any
building, structure or physical obstruction of any kind, other than trees and shrubbery, or permit
the same to be so erected or maintained, except such as the Grantee may specifically consent, to
in writing, which consent shall not be unreasonably withheld or delayed.
FOURTH: The guy wire and associated underground anchor as from time to time
installed, constructed and maintained by the Grantee in the Easement Area shall at all times be
and remain the property of the Grantee, and be maintained and serviced exclusively by the
Grantee.
FIFTH: The Grantor covenants that it is seized of the Property and, for itself, its
successors and assigns, forever warrants its title thereto and will defend the easement and right-
of-way herein granted, forex~er, against all lawful claims and demands.
SIXTH: The Grantee covenant that, in the event the surface of the Easement Area is

· line of North Road (CR 48) along the arc of a curve bearing to the left having a radius of
683.20 feet with a length of 13.30 feet to the true point or place of beginning;
Thence through part of Lot 005.000 North 23° 14' 07" West 44.20 feet to a point; Thence
North 73° 03' 00" East 10.06 feet to a point; Thence through part of Lot 005.000 South 230
14' 07" East 43.16 feet to a point; Thence along the northerly line of North Road (CR 48)
along the are of a curve bearing to the right having a radius of 683.20 feet with a length of
10.00 feet to the true point or place of beginning;
Containing within said bounds 437.35 sqUare feet more or less.
