KAVANAGH, residing at 2300 Maple Lane, Greenport, New York 11944, as executor of the last will and testament of JAMES P. KAVANAGH, who died on the 17th day of August, in the year Two Thousand One, the party of the first part, and BRIAN K. KAVANAGH, residing at 2300 Maple Lane, Greenport, New York 11944, party of the second part, WITNESSETH, that the party of the first part, to whom letters testamentary were issued by the Surrogate's Court, Suffolk County, New York on September 28, 2001, and by virtue of t}ae power and authority given in and by said last will and testament and/or by Article 11 of the Estates, Powers and Trusts Law, and in consideration of Ten ($10.00) Dollars, paid by the party of the second part, does hereby grant and release unto the party of the second part, the distributees or successors and assigns of the party of the second part forever, PARCELI: ALL THAT CERTAIN plot, piece or parcel of land with the buildings and improvements thereon erected, situate, lying and being at East Marion, Town of Southold, County of Suffolk and State of New York, bounded and described as follows:- BEGINNING at an iron pipe in the northerly line of the land of Kavanagh on the division line between the land of Bernard & Theodore Kaplan (Dawn Estates) and the land of Kavanagh which said iron pipe is distant 147.08 feet easterly as measured along said division line having a course North 58 degrees 29 minutes 10 seconds East from a point in the easterly side of Maple Lane where the said easterly side of said Maple Lane (a 50 foot private road) is intersected by the above division line, said point of beginning being the southwesterly comer of the premises described herein; RUNNING THENCE through other land of Bernard and Theodore Kaplan, the following two courses and distances: (1) North 33 degrees 30 minutes 50 seconds West, 135.52 feet to an iron pipe; (2) North 43 degrees 35 minutes 40 seconds East, 36.11 feet to an iron pipe in the westerly li~e of the land of Rutkowski; RUNNING THENCE along said land of Rutkowski the following two courses and distances: (1) North 58. degrees 49 minutes l0 seconds East, 87.89 feet; (2) South 33 degrees 30 minutes 50 seconds East, 140 feet to an iron pipe which iron pipe marks the division line between the land of Rutkowski and the land of Kavanagh; 140 feet to an iron pipe which iron pipe marks the division line between the land of Rutkowski and the land of Kavanagh; RUNNING THENCE along the land of Kavanagh, South 56 degrees 29 minutes 10 seconds West; 123 feet to the southwesterly comer of the premises hereby described, the point or place of BEGINNING. BEING AND INTENDED TO BE part of the same premises conveyed to James P. Kavanagh and Kathleen Kavanagh, his wife, be deed from Bernard Kaplan and Theodore Kaplan d/b/a Dawn Estates Shopping Center dated February 18, 1966, and recorded in the Suffolk County Clerk's Office on February 24, 1966, in Liber 5916 page 264. PARCEL II: ALL THAT CERTAIN plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Southold, near Greenport, County of Suffolk and State of New York, bounded and described as follows:- Bounded on the North by lands now or formerly of Kavanagh and Crescent Beach Condominium 208 feet, more or less; Bounded on the East by lands now or formerly of Mourkakos, 120 feet, more or less; Bounded on the South by lands now or formerly of Crescent Beach Condominium Owners Association, 208 feet, more or less; and Bounded on the West by lands now or formerly of Crescent Beach Condominium Owners Association, 120 feet, more or less. TOGETHER WITH a right of way from the northwesterly comer of the premises northerly about 2100 feet to the Main Road over Maple Lane as the same is Shown on Map of Section 1, Cleaves Point, filed in the Suffolk County Clerk's Office September 10, 1957, as Map 2752. SUBJECT TO a right of way 15 feet in width running from the southerly end of Maple Lane to the northwesterly comer of the promises, thence easterly along the northerly boundary of the premises about 270 feet, thence southerly along the easterly line of the premises and land of Rutkowski about 287 feet; thence southeasterly along other land of Rutkowski about 250 feet. This deed is givereto correct an' error in the description in a certain deed dated June 20, 2000, between James P.
