2. VARIANCE. By resolution of the Board it was determined that

The findings and determination of the Board are as follows:
Appellant has appealed to this Board seeking a variance for per-
mission to divide a flag-shaped parcel, containing approximately
30,200 square feet in area, into two parcels, lO,O15 approximately
and 20,200 square feet approximately, with insufficient road frontages
of 70 feet along Pine Tree Road. Existing on proposed Parcel 35A is
a one-family dwelling, and immediately west of same is a neighboring
one-family dwelling.
Article III, Section lO0-31 and Bulk Schedule of the Code
requires a minimum area of 40,000 square feet and a minimum width
(road frontage) of 150 feet. The Board finds that the relief
requested is substantial in relation to the Code requirements;
that if the variance is granted substantial detriment to adjoining
properties will be created inasmuch as the area is very congested;
that a substantial change will be produced in the character of the
neighborhood; and that the interests of justice will not be served
by the granting of the relief requested herein.
On motion by Mr. Goehringer, seconded by Mr. Grigonis, it was
RESOLVED, that Peter V. Izzo's application for a variance
dated December 1, 1980 be denied without prejudice.

New York; more particularly known as Lots 34 and 35A, Map of
Nassau Farms No. 1179; County Tax Map Item No. 1000-104-2-9 and 10.

NOTICE OF NO SIGNIFICANT EFFECT
UPON THE ENVIRONMENT
Pursuant to Section 617.13 of the New York State Environmental
Quality Review Act (SEQRA}, Article 8 of the Environmental Conser-
vation Law, and Section 44-4 of the Southold Town Code, the South-
old Town Board of Appeals has determined the following-described
project is classified as a Type II Action, not having significant
adverse effects upon the environment. Pursuant to Section 617.5{a)
of the New York State Environmental Quality Review Act, no further
determination or procedure is required herein. This declaration
should not be considered a determination made for any other depart-
ment or agency which may also be involved or any other project not
covered by the within application.
Applicant has submitted an environmental assessment in the short
form which indicates that no adverse effects were likely to occur to
the environment. The subject property does not fall within 300 feet
of tidal wetlands and pursuant to Sec. 661.4(B){1) and 661.7 of the
Environmental Conservation Law, Article 25 would not require a permit
by the N.Y.S. Dept. of Environmental Conservation.

Dear Mr. Grigonis:
The Planning Board reviewed your referral regarding Peter
V. Izzo who is seeking a variance of insufficient area and width
of two proposed parcels located at the west side of Pine Tree
Road, Cutchogue.
The Planning Board would require this matter to follow the
subdivision procedures of the Code of the Town of Southold if
the variance is granted. As proposed the Planning Board would
not approve this subdivision.

Dear Mr. Fisher:
In 1970 I purchased a lot (#34) shown on the attached
survey map of the Nassau Farms area, in Cutchogue. Prior to that
in 1965 I bought a home situated on lot #35A, also shown on the
map.
It is my hope to sell our present home on lot 35A and
then build a new home on lot #34. I realize that I must receive
approval from the Town Board and therefore respectfully.submit this
request through your office.
In addition to the survey map I have also enclosed a copy
of the Deed to lot #34.
I appreciate your consideration of this matter and will be
guided by your response.
