PAYSON, 30 Benjamin Day Drive, Wrentham, Massachusetts, 02093, all as equal TENANTS IN COMMON party of the second part, WITNESSETH, that the party of the first part, in consideration of dollars lawful money of the United States, paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the parry of the second part forever, ALL that certain plot, piece or parcel of land, with the building and improvements thereon erected, situate, lying and being in the at Mattituck, Town of Southold, County of Suffolk and State of New York, known and designated as lots nos. 32 and 33 on a certain map entitled, "Amended Map of Mattituck Park Properties, Inc., Mattituck, N.Y., said map being made by Daniel R. Young, P.E. and L.S. from actual survey completed June 11, 1924" and filed in the Office of the Clerk of the County of Suffolk on January 12, 1926 as Map No. 801, which said lots are bounded and described as follows: DIST: BEGINNING at a point on the southwesterly side of Sigsbee Road distant 1564.40 feet SECTION: southeasterly from the corner formed by the intersection of the southeasterly from the corner formed BLOCK: by the intersection of the southeasterly side of Route 25 (Main Road)with the southwesterly side of LOT: Sigsbee Road; RUNNING THENCE South 20 degrees 38 minutes East along the southwesterly side of Sigsbee Road 100 feet; iI THENCE.South 69 degrees 22 minutes West 144.11 feet to land now or formerly of Husing; THENCE along said last mentioned land, North 20 degrees 29 minutes West 100 feet; RUNNING THENCE North 69 degrees 22 minutes East 143.83 feet to the southwesterly side of Sigsbee Road at the point or place of beginning. THE Grantor reserves the right to the exclusive use and occupancy of the premises during the Grantor's lifetime, with the Grantor to pay for all maintenance and repairs, water and sewer charges, insurance charges, and taxes relating to said premises. Said life use shall be personal to Grantor, and shall not be subject to assignment or lease, except as otherwise provided in this paragraph. The Grantor reserves the power to appoint the remainder and/or Grantor's life uses in the premises to any one or more of the issue of the Grantor, siblings of the Grantor, or issue of the Grantor's siblings, or the spouses or surviving spouses of any of the foregoing persons, with the term "issue" being deemed to include persons who have been adopted according to law but not born out of wedlock. This power shall be exercisable or may be relinquished during the Grantor's lifetime by a deed to the Grantee herein or to others who are member.;of the class of appointees set forth herein, making express reference to this power and executed and recorded in the County Clerk's office where this deed is recorded, prior to the Grantor's death. No exercise of this power shall be deemed to release the Grantor's life estate unless such a release is explicitly made in a deed. The exercise of this power shall not exhaust it and unless the power is specifically released in such a deed, the deed recorded last shall control as to any ambiguities or inconsistencies. BEING AND INTENDED TO BE the same premises as conveyed to the party of the first part in deed dated September 2, 1980 and recorded on September 10, 1980 in Liber 8879 on page 445. (I TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors app, assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying,the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
