WITNESSETH, that the party of thc first'part, in consideration ofTEN (SI0.00) dollars,
lawful money ofthe United Slates paid by the pmly of the second part, does hereby grant and release unto
the party of the second part, the heirs or successors and assigns of the party of the second pan forever,
ALL that tract or parcel of land situate in the Village and Town of Southoid, County of Suffolk and
State of New York, bounded and described as follows:
BEGINNING at a point on the easterly line of Oaklawn Avenue at the southwesterly comer of land of
Charles F. Van Duzer and running thence easterly along said land of Chaxles F. Van Duzer 206 feet to the
southeasterly comer of said land of Charles F. Van Duzer; thence southerly in a straight line toward the
northeasterly comer of land of Richard T. Merwin 88.21 feet; thence westerly along other land of the parties
of the first pan 207.67 feet to a point on the easterly line of Oaklawn Avenue 100 feet southerly from said
southwesterly comer of land of Charles F. Van Duzer; thence northerly along said easterly line of Oaklawn
Avenue 100 feet to the point of BEGINNING.
TOGETHER WITH all right, title and interest of the party of the first pan in and to Oaklawn Avenue in
front of and adjacent to said premises.
BEING AND INTENDED TO BE the same premises conveyed to Harry G. Waite, deceased, by deed
dated March 12, 1948 recorded in the Office oftbe Clerk oftbe County of Suffolk on March 17, 1948
in Liber 2807 page 406.
THIS DEED IS MADE TO CORRECT THE TRANSFER OF A ONE-THIRD (I/3) UNDIVIDED
INTEREST TO BARBARA NEER BY DEED DATED DECEMBER 5, 2002 RECORDED IN THE'
OFFICE OF THE CLERK OF THE COUNTY OF SUFFOLK ON DECEMBER 11, 2002 IN
LIBER 12224 PAGE 579 WHICH TRANSFER WAS MADE TO BARBARA NEER IN ERROR
AND IS HEREBY ACKNOWLEDGED AS SUCH BY ALL THE PARTIES.
THE GRANTOR HEREIN RESERVES A LEGAL LIFE ESTATE IN THE PREMISES for thc term
of thc Grantor's life.
TOGETHER with all right, title and interest, ifany, of the party of the first pm in and to any streets and
marls abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and nil the estate and rights of the party ofthe first part in mud to said
VE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party oftbe second part forever.
AND the party of the first part covcnants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for thc purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the impmvemenl before using any part of the total of
the same for any other purpose. Thc word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
