The following action was taken by the Southold Town Planning
Board at a regular meetiug held February ll, 1980.
RESOLVED that on an over-view of minor subdivision of Fishers
Island Development Corporation #184 in relationship to the adjacent
parcels and the parcel this is proposed to be carved out of the
Planning Board sees no need of road construction nor municipal
drainage facilities.

DeHaan application to the Board of Appeals. The Board of Appeals'
has written the Planning Board indicating that it does not wish to
be lead agency in this matter. The Planning Board will write the
Board of Appeals saying that since there is ne filed subdivision with
regard t? this property but probably in the future it should be such
because xt is considerably over the 40,000 square foot minimum.for a
building lot in the township. Consequently, at this point, ~vhere the
town agency does not wish to be lead agency under the State Environ-
mental Quality Review ~ct requirements, it is suggested that probably
the next closest agency should be the New York State Department of
Environmental Conservation. ~-
Knights of Columbus site plan. This has been received in the office
and Mr. 0rlowski will study same and return to the Board with a
report.

Appeal applications have been received by this Board
to be scheduled for public hearings; however, the Board
members feel that these two applications should first be
reviewed by the Planning Board since they involve subdi-

A Variance to the Zoning Ordinance
is requested forSOOk permission to subdivide a parcel with insufficient area, lot
width, yard requirements from a large parcel of land containing approximately 10.2 acres.
The proposed subdivision of the property is shown on "Minor Subdivision Plan of Property
to be conveyed by Fishers Island Development Corporation to Island Interiors" dated
November 19, 1979 by Chandler, Palmer & King, Norwich, Connecticut, which is attached
hereto as Exhibit A. Attached hereto as Exhibit B is an excerpt of the Building Zone Map
of the Town of Southold with the property t.o be .divided outlined in red.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP b~au~ as shown on Exhibit A there is an existing building with the nota-
tion "Building to be Removed", which is located on Petitioner's Property on Fox Avenue.
This building contains an area of 750 square feet and 'encroaches somewhat on Fox Avenue.
Jose V. Rodrig~ez d/b/a Island Interiors has conducted an upholstery repair business
from this building for approximately ten years. Mr. P~driguez is desirous of modernizin.
his facilities so that he can run his business on a more efficient basis. Your Peti-
tioner has agreed to sell Mr. Rodriguez a parcel of land immediately to the north of
this present building for the purposes of erecting an attractive metal building so that
he may continue his upholstery business and serve Fishers Island. The sale is subject
to obtaining a Building Permit from the Town of Southold and on the condition that Mr.
Rodriguez remove the existing building.
The business is presently zoned in a "B-l" General Business District and requires an
area of 30,000 square feet with 150 lot width~ a front yard of 35 feet, side yards
of 25 feet each, and a rear yard of 35 feet~. 'AS shown on'Exhibit A Mr~'.Rodriguez pro-
poses to erect a building 35 feet by 32 feet, containing 1,120 square feet~and to locate
same on a lot 65 feet by 120 feet containing 7,800 square feet, which is more than ade-
quate for Mr. Rodriguez's needs. Petitioner believes that to sell Mr. P~driguez a
30,000 square foot parcel of land is not in Mr. P~driguez's interest or the interest of
the Petitioner considering the topography and the uses of the balance of the land. The
proposed ~arcel of 7,800 square feet is more than adequate to handle the present and *

2, The hardship created is UNIQUE and is not shored by all properties alike in the immediate
vicinity of this property and in this use district because the other existing business property in
this neighborhood contains land with sufficient area to accommodate their businesses
thereon. Petitioner's property is 10.2 acres and the present proposal to sell
7,800 square feet to Jose V. Rodriguez d/b/a Island Interiors is a reasonable use
of the land.
3. The Variance would obse~e the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the granting of the variance will not change the
existing use of the property and will be an improvement because Island Interiors will
erect an attractive building and remove the existing building.

REASON FOR APPEAL:

future needs of Mr. Rodriguez's upholstery business. The proposed parcel is in
conformity with the business neighborhood in which there are presently operational
businesses. Furthermore your Petitioner does not want to sell any more land because
the future uses of the balance of the Petitioner's property are uncertain at the
present time.
The parcel proposed to be subdivided is surrounded on three sides by other land
of your Petitioner and a possible parking area will have to be installed to the
south of Mr. Rodriguez's proposed parcel to accommodate a grocery store and to the
north there is a proposed sewage treatment plant which will have to be installed.
It is presently unclear as to the amount of property that will be required for the
installation and operation of this plant. Proper planning dictates that the amount
of land sold for Mr. Rodriguez's upholstery business be in conformity with not only
the surrounding neighborhood but the future uses of Petitioner's property. There
should be no violations of any existing Department of Health requirements because
the proposed property is currently serviced by water and sewage lines. The area to
be sold to Mr. Rodriguez is primarily of a level nature and due to the topography
of Petitioner's property, it would serve no useful purpose to increase the size of
Mr. Rodriguez's lot. The building he proposes, although requiring variances from
the existing zoning standards, will be in conformity with the neighborhood and will
provide adequate off-street parking for his customers.
