ZONING BOARD OF APPEALS
After investigation and inspection, the Board finds that
applicant is requesting permission to construct proposed dwell-
ing with insufficient sideyards, 8'9" on the south and 10' on
the north. The Board finds that the subject property is very
narrow in width, 75' along the road and 60' at the rear line
however, there appears to be adequate practical area in which
to build the proposed 50-foot wide house with sideyards of 9
foot and 12 foot. The Board also finds that the property is
located in an A-4 Flood Zone restricting new construction to
an 8-foot elevation from mean sea level, for which applicant
has not requested relief and therefore the Board assumes he
intends to comply with the restrictions of the Flood Damage
Prevention Law. The Board agrees with the reasoning of the
applicant.
The Board finds that the circumstances present in this
case are unique, and that strict application of the ordinance
would produce practical difficulties or unnecessary hardship.
The Board believes that the granting of a variance in this case
will not change the character of the neighborhood and will
observe the spirit of the ordinance.
On motion by Mr. Douglass, seconded by Mr. Goehringer,
it was
RESOLVED, that MARINO FARAGUNA, in Appeal No. 2687, be
GRANTED a Variance to the Zoning Ordinance, Article III,
Section 100-31, SUBJECT TO THE FOLLOWING CONDITIONS:
(1) That the sideyards may not be less than 12' on
one side and 9' On the other side;
(2) That the existing dwelling to be used as an acces-
sory building for storage and not to be permitted to be
rehabilitated to a living dwelling~onq9 a Certific~tD of Occu-
pancy has been issued for the new awe£1ing propose~ herein;
(3) Compliance with the restrictions of the Flood Damage
Prevention Law of the Town of Southold.

Dear Mr. & Mrs. Faraguna:
If you will recall, before the issuance of the build-
ing permit to construct your new home at 5675 Skunk Lane,
Cutchogue, N.Y. you made an appeal to the Zoning Board of
Appeals for reduction of the side yards. Un~r appe~
#2687 dated May 22.198~ you were granted the reduction
you requested under condition #1. Condition #2 stated
that the existing dwelling be used as an accessory stor-
age building and not to be used for living purpose once
the Certificate of Occupancy has been issued. A copy of
this appeal is herewith.
A Certificate of Occupancy was issued on May 14,1985
for the new dwelling. It has come to our attention that
the old building is still being used for living purposes,
this is a violation under appeal #2687 and must be correct-
ed.
Enclosed find application for a building permit to
convert this building for accessory use as a storage build-
ing. If you have any questions regarding this matter con-
tact me at this office.

Dear Mr. Faraguna:
Recently you filed an application for a variance
regarding property known as 5675 Skunk Lane, Cutchogue
to construct a dwelling with insufficient Sideyard area.
Before this matter may be scheduled for a public
hearing, the following documents are required:
(a) Six surveys showing the proposed project and
the existing buildings and showing the sideyard setbacks
proposed.
(b) Also, please indicate in the surveys what the
elevation of the property in the area of the proposed
dwelling is in relation to the mean sea level line.
