to land now or formerly of John H. Carroll and another;
RUNNING THENCE Along said lands, South 77 degrees 41 minutes West, 466.41 feet to land now or formerly
of3on C. Kerbs;
RUNNING THENCE Along lands now or formerly of Kerbs, North 50 degrees 43 minutes West, 85.88 feet to
land now or formerly of Kerbs;
RUNNING THENCE Along lands now or formerly of Kerbs, North 39 degrees 17 minutes East, 366.95;
RUNNING THENCE still along said land North 46 degrees 41 minutes 00 seconds East 342.32 feet to the
southerly side of County Road 48 (North Road);
RUNNING THENCE Easterly along the southerly side of county Road 48 (North Road) along the arc of a curve
having a radius of 2,259.01 feet a distance of 25.05 feet and subject to the point or place of the BEGINNING.
Subject to a certain right of way contained in A Boundary Line Agreement Signed on
November 27,2001 and recorded in the office of the Suffolk County Clerk on
January 14, 2002 in Liber 12163 Page 180
BEING AND INTENDED TO BE part of the same premises conveyed to the party of the first
part by deed from John M. Kerbs and Margaret A. Kerbs, his wife, dated 1/27/88 and
recorded in the Suffolk County Clerk's Office on 2/26/88 in Liber 10549 page 52, and part of
the same premises conveyed to Margaret A. Kerbs by deed from John M. Kerbs and Margaret
A. Kerbs, his wife, dated 01/27/88 and recorded in the Suffolk County Clerk's Office on
2/26/88 in Liber 10549 page 48.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way xvhatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
