BARGAIN & SALE DEED

BETWEEN ZOUMAS CONTRACTING CORP, having its principal place of
business at 18 Deerfield Drive, P. O. Box 361, Wading River, New York 11792
Party of the first part, and JOHN N. BIEBER residing at

WITNESSETH, that the party of the fust part, in consideration of Ten Dollars and other
valuable consideration paid by the party of the second part, does hereby grant and release unto
the part of the second part, the heirs or successors and assigns of the party of the second part
forever.
ALL, that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Cutchogue, Town of Southold, County of Suffolk and State
of New York, known and designated as Lot #I I as shown on a certain map entitled, "Map of
Woodbine Manor" and filed in the Suffolk County Clerks Office on December 15, 1986 as Map
# 8239, which said lot is more particularly bounded and described as follows:
BEGINNING at a point on the Northeasterly side of Duck Pond Road distant 125.00 feet North,
as measured along the northeasterly side of Duck Pond Road, from the extreme northerly point
of the arc of a curve that connects the Northeasterly side of Duck Pond Road and the Northerly
side of Thar Lane, said arc of a curve has a radius of 25.00 feet and a length of 39.27 feet;
RUNNING THENCE along the Northeasterly side of Duck Pond road, North 39 degrees 00
minutes 00 seconds West 150.00 feet to the division line between Lot 11 and Lot 10 as shown on
said aforementioned map; RUNNING THENCE along said division line South 51 degrees 00
minutes 00 seconds East 270.00 feet; RUNNING THENCE South 39 degrees 00 minutes 00
seconds East 150.00 feet to the division line between Lot 11 and Lot 12; RUNNING THENCE
along said division line South 51 degrees 00 minutes 00 seconds West 270.00 feet to the
Northeasterly side of Duck Pond Road and the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 8/97 and recorded 9/23/97 in Liber 11853 at CP364
The above conveyance has been made with the unanimous consent in writing of all the
stockholders of the party of the first part.
TOGETHER with all right, title and interest, if any, of the party of the fust part in and to any
streets and roads abutting the above described premises to the center lines thereof: TOGETHER
with the appurtenances and all the estate and rights of the party of the fust part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the fust part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied fust for the purpose of paying
the cost of the improvement and will apply the same fust to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it to read "parties" whenever the sense of this
indenture so requires.
IN WITNESS WHEREOF, the party of the fust part has duly executed this deed the day and
year fust above written.
