The reasons why the south side yard is selected for a swiping pool is:
1, It is the highest point on the property
2. It get0 the sun ell day
3. No trees vould have to be cut dmm and no leaves mauld blo~ into the pool.
4. A kitchen extension is plannedwith sliding glass doors to patio/pool area
5. ! have a small child end would,ant to be able to match him from the hitches.
In the other areas of the property, all face the follovlng problems:
B~ck~erd:
1. There is no afternoon sun and the house will end up shading the pool area.
2. The house is on a bluff. The weight of water n~ght potentially cause the
bluff to collapse. The bluff is 40* in the air.
3. The kitchen is in the front of the house and it ~ould be difficult to
keep · close eye on my son.
Northside Yard:
The property slopes do~nvard at least 15 feet which vould cause considerable
water overflo~ problem when it rains.
Much more expensive to build retaining walls and construction.
The swinwo~ng pool installer has advised strongly against this area.
I would not be able to watch my son from the house as this area is off
any master bedroom.
The cesspool overflovo every year and u~st be pumped. I vould not want
to put a pool near it.
Front Yard:
1. Our oil tank is in the front yard.
2. There is electricity running by overhead wires from the house to the garage.
3. Our vaterpump for the house is in the rear of the garage and there are
underground mater lines.
4. Well-established trees vould have to be cut down as they vould shade any
possible proposed pool area. Additionally, these treusmould cause considerable
leaves in and around the pool area.
The property slopes down in the front yazd and everything mould blov into
the pool.

back of tte garage viii come thru the front yard.
All the may in front of the property is too far avay from the houoe and
kitchen. I ~uld not be able to match my son or other children in the
pool from the house.

After investigation and inspection, the Board finds that
applicant is requesting permission to construct swimming pool
in sideyard area due to the reason that the house is constructed
too close to cliff on the bay and no other location is suitable.
Upon inspection of the premises, the Board has found that the
premises contains 41,500 square feet, and that there is an ac-
cessory building (garage) located in the frontyard area off
Nassau Point Road. The Board feels there is adequate area
in which to construct the swimming pool other than in the
sideyard as requested. Therefore, the Board does not agree
with the reasoning of the applicant.
The Board finds that the circumstances present in this
case are not unique, and that strict application of the ordi-
nance would not produce practical difficulties or unnecessary
hardship. The Board believes that the granting of a variance
in this case will change the character of the neighborhood and
will not observe the spirit of the ordinance.
