THIS INDENTURE, made the 25u~ day of November, Two Thousand Two
BETWEEN
MATFHEW McKIERNAN and JOSEPHINE McKIERNAN, his wife, msidin§ at 380 Tuthill
Road, Southold, New York 1197],

JOHN CORBLEY, residing at 542 Wilbur Avenue, Cranston, Rhodc Island 02921,
party of the second part,
WITNESSETH, that thc party ol'the first part, in consideration often Dollars and othcr valuable
consideration paid by the party of thc second part, does hereby grant and release unto thc party
of the second part, the heirs or succe~ors and assigns ol'the party of the second pan forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New
York, known and designated as Lot No. 3 on a certain map entitled "Map of Yennecott Park"
and filed in the Office of the Clerk of the County of Suffolk on October 9, 1968 as Map
Number :5187, said lot being more particularly bounded and described according to said map
as follows:
BEGINNING at a point on the westerly side of Tuthill Road distant 433.29 feet northerly from
the extreme northerly point of the arc of a curve that connects the westerly side of Tuthill Road
and the northerly side of Yennecott Drive, said point of beginning also being at the division
line between Lots 2 and 3 as shown on said aforementioned map;
RUNNING THENCE from said point or place of beginning along said division line North 71
degrees 36 minutes 10 seconds West 17:5.00 feet;
THENCE North 18 degrees 23 minutes 50 seconds East 130.00 feet;
THENCE 'along the division line between Lots 3 and 4, South 71 degrees 36 minutes 10
seconds Fast 175.00 feet to the westerly side of Tuthill Road;
THENCE along thc westerly side of Tuthill Road South 18 degrees 23 minutes 50 seconds
West 130.00 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first pan by
deed from Richard A. Mazguiski and Joanne L. Mazgulski, dated November 21, 1996, and
recorded December 3, 1996, in the Office of the Suffolk County Clerk in Liber 11804, Page
404.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with thc appurtanances and all the estate and rights of thc party of the first part in and to said
premises; TO HAVE AND TO HOLD thc premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not douc or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND thc party of thc first part, in compliance with Section 13 of thc Lien Law, covenants that
the party of the first part will receive thc consideration for this conveyance and will hold the
right to receivc such consideration as a trust fund to bc applicd first for thc purpose of paying the
cost of the improvement and will apply thc same :fit'st to thc payment of thc cost o£ the
improvemcnt before using any part of thc total of thc same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
