HYDE, '~ Residing at 140 Waldo Street, Copiague, NY 11726 [,arty of the second part, DIST 1000 SECT 040.01 BLK LOT 003.000 WITNESSETH, that the party of the first part, in consideration ofTEN DOLLARS and other consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second paid forever, ALL that certain plot, piece or parcel of land, with the buildings and improvemehts thereon erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New York, bounded and described and follows: Unit No. 3, in a certain development known as Pheasant Run Estates Condominium 1, which unit is so designated in a certain Declaration Establishing a~an of Condominium Ownership of premises located at Greenport, Town of Southold, County of Suffolk and State of New York, pursuant to Article 9-B of the Real Property Law of the State of New York "which established a plan for Condominium ownership of said building and the land on which it stands, both together hereinafter referred to as the "property" and which declaration is dated December 22, 1994, a!ad was recorded in the Office of the Clerk of Suffolk County on December 22, 1994, in Libor 11707 page 664 and in Declaration dated January 20, 1995 and recorded April 5, 1995., in Liber 11720 cp 628, first Amendment to the Declaration in Liber 11778 page 167, together with an undivided 5% interest in common with the other unit owners in the "common elements of the property ads the same as described in the aforesaid Declaration. The Grantor herein is the same person as the Grantee in Deed dated January 27, 1997 recorded February 5, 1997 in Liber 11814, CP 858. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads *butting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part furever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
